Title:Varstvo osebnih podatkov v ezdravju : diplomsko delo

Abstract:Diplomska naloga obravnava eZdravje s pravnega vidika, s poudarkom na varovanju osebnih podatkov. Opredeljen je pojem eZdravje ter njegove prednosti in pomanjkljivosti. Glavna tema diplomske naloge je varstvo osebnih podatkov v eZdravju, njegova pravna ureditev na mednarodni in nacionalni ravni, ter pravna ureditev v Evropski uniji (v nadaljevanju EU). Diplomska naloga temelji na Zakonu o varstvu osebnih podatkov, Zakonu o pacientovih pravicah in aktih EU, ki zavezujejo našo državo. Na področju pravne ureditve varstva osebnih podatkov v EU so pomembne predvsem uredbe in direktive, upoštevajo pa se tudi drugi dokumenti institucij EU. Prav tako je potrebno pri varovanju osebnih podatkov spoštovati deklaracije in mednarodne pogodbe. V diplomski nalogi ugotavljam, da vsakodnevno prihaja do nezakonitih in nepooblaščenih vpogledov v zdravstveno dokumentacijo. Osebni podatki o zdravstvenem stanju namreč spadajo med občutljive osebne podatke, zato je še posebej potrebno njihovo varstvo. Prav tako je bistvena seznanitev pacienta z lastno zdravstveno dokumentacijo, ki je ena izmed njegovih temeljnih pravic. Pomembno področje predstavlja tudi posredovanje osebnih podatkov pacienta, ki je še posebej ogroženo. V primeru kršitev varstva osebnih podatkov ima posameznik na voljo kazenskopravno ali civilnopravno varstvo pri pristojnih organih.

Title:Protection of personal data in ehealth
Abstract:The thesis examines eHealth from a legal point of view, with an emphasis on the protection of personal data. The concept of eHealth is defined and its advantages and disadvantages. The main topic of the thesis is the protection of personal data in eHealth, its regulation at the international and national level, and the legal framework in the European Union (hereinafter EU). The thesis is based on the Personal Data Protection Act, the Patient Rights Act and the EU acts that bind our country. Regulations and directives, as well as other documents from the EU institutions, are important in the field of legal protection of personal data in the EU. It is also necessary to observe declarations and international treaties for the protection of personal data. In my graduation thesis, I find that daily illicit and unauthorized insights into medical documents are coming up. Personal health data belongs to sensitive personal data, therefore it is particularly necessary to protect them. It is essential to familiarize the patient with his own medical records, which is one of his fundamental rights. An important area is also the transmission of personal data of a patient, which is particularly at risk. In the event of a breach of the protection of personal data, an individual is provided with criminal or civil protection with the competent authorities.
