Abstract:Apostille pomeni potrditev resničnosti podpisa, funkcije podpisnika listine in žiga ali pečata na listini. To potrditev opravi pristojni organ države izvora listine, ki se bo uporabljala v drugi državi in se ne navezuje na njeno vsebino. Potrditev, oziroma Apostille, se na listino pripne, odtisne ali priveže. Apostille je nastal, da bi se izognili postopku konzularnega potrjevanja tujih listin, t.i. »dolga overitev« oziroma legalizacija. Nekatere države so podpisale Haaško konvencijo o odpravi legalizacije tujih javnih listin z dne 05.10.1961 in jo nadomestile z žigom Apostille. Listine, ki so opremljene s tem žigom v državah podpisnicah Haaške konvencije ni potrebno še dodatno overiti.

Title:Legal characteristics of apostille and comparison with consular verification of foreign documents
Abstract:Apostille means confirmation of the authenticity of the signature, the function of the signatory and the stamp or seal on the document. This confirmation shall be carried out by the competent authority of the country of origin of the document, which will be used in another country and it is not related to its content. The confirmation, or Apostille, is pinned, stamped or affixed to the document. Apostille was created in order to avoid the process of consular confirmation of foreign documents, i.e. "long authentication" or legalisation. On 5 October 1961 some countries signed The Hague Convention Abolishing the Requirement of Legalisation for Foreign Public Documents and replaced it with the Apostille stamp. Documents which are equipped with this stamp in the signatory countries of the Hague Convention do not have to be further certified.
