Title:Delo na črno v gostinstvu : diplomsko delo univerzitetnega študijskega programa Varstvoslovje

Abstract:Delo na črno predstavlja problem, ki ga pristojni organi in zakonodajalec poskušajo izkoreniniti že leta. To je protizakonita dejavnost, ki se pojavlja in ponavlja že vrsto let ter omejuje in slabi gospodarsko dejavnost. Leta 2014 so bili v upanju na boljši nadzor nad tovrstnimi kršitelji sprejeti novi ukrepi za boj proti delu na črno, kot tudi večje globe kršiteljem. Najbolj pogosto se delo in zaposlovanje na črno kažeta v večjih gospodarskih panogah (npr. v prometu, gradbeništvu, gostinstvu) (Dernovšek, 2013). Podjetja, oziroma delodajalci, želijo na ta način zmanjšati svoje stroške in privarčevati, posamezniki pa želijo npr. dodatno zaslužiti, se izogniti plačevanju davkov ipd. Negativne posledice pa občutijo vsi prebivalci, saj je zaradi dela in zaposlovanja na črno oškodovan državni proračun. Problem dela na črno je v nemerljivosti, kar pomeni, da o tem pojavu nimamo povsem točnih podatkov, v kolikšni meri se kaže na letni ravni. V diplomskem delu sta predstavljena delo in zaposlovanje na črno v gostinstvu, na kakšen način se izvajata ter značilnosti takšnega opravljanja. Predstavljeni so tudi razlogi, zaradi katerih prihaja do dela na črno, ter sankcije in posledice. Predstavljene so inšpekcijske službe, njihove pristojnosti in učinkovitost na tem področju. Opravili smo tudi raziskavo, pri kateri smo več oseb z izkušnjami z delom v gostinstvu anketirali glede izkušenj s tovrstnim delom, predvsem pa nas je zanimalo, zakaj se posameznik odloči za delo na črno v gostinstvu, katere so pozitivne in negativne posledice ter ali bi v prihodnje še zmeraj opravljali delo na črno v tej panogi.

Title:Undeclared work in the Restaurants, Bars and Food Services Industry
Abstract:Undeclared employment is a problem which authorities and legislators have been trying to uproot for years. It is an illegal activity that is limiting and weakening economic growth. In 2014, new measures were taken to combat undeclared work in the hope of better supervision of such offenders. Higher fines for violators were also introduced. Most often, undeclared work and recruitment is found in major industries (e.g. transport, construction, catering) (Dernovšek, 2013). Employers want to reduce their costs and save money, whereas individuals, on the other side, want to generate additional earnings by paying lower taxes, etc. Downsides are felt by all citizens as well as the state economy. The problem of undeclared work is also its immeasurability, which means that we may not have accurate data on the extent to which they are shown on an annual basis. Inspection services, their responsibilities and efficiency in this field are presented, as well as working activities that are performed without a valid contract and are not included in the categorization of work and undeclared employment, which is also stipulated in the law, where the law also allows it under special conditions. Our thesis presents undeclared employment in the Restaurants, Bars & Food Services Industry, how it occurs and its characteristics, reasons why it takes place, as well as sanctions and consequences. We conducted a survey in which several people with experience in Restaurants, Bars & Food Services Industry were interviewed about their experiences with this kind of work. We were particularly interested in why an individual decides to take part in undeclared work in the hospitality industry, what are positive and negative consequences and whether an individual would take part in undeclared work in the industry in the near future.
