Title:Analiza skladnosti tehnologije blockchain s Splošno uredbo o varstvu podatkov : diplomsko delo

Abstract:Tehnologijo blockchain se opredeljuje kot enega najpomembnejših tehnoloških izumov v zadnjem času. Njen prodor je posledica velike priljubljenosti kriptovalut, vse bolj pa se jo poleg ekonomskega področja omenja tudi na številnih drugih področjih. V ospredje je prišla vzporedno s Splošno uredbo o varstvu podatkov – GDPR, ki prebivalcem Evropske unije prinaša več pravic pri varovanju njihove zasebnosti. Že na podlagi imena uredbe lahko sklepamo, da vsebuje splošne opredelitve, kar otežuje razumevanje obveznosti pri obdelavi osebnih podatkov v sistemih blockchain. V diplomskem delu raziskujemo skladnost tehnologije blockchain in Splošne uredbe o varstvu podatkov. Namen naloge je ugotoviti, ali se pri tehnologiji blockchain obdelujejo osebni podatki in v kakšni meri sledi pravilom uredbe, na kakšen način se zoperstavlja zlorabi osebnih podatkov in kaj za tehnologijo pomeni morebitna potreba po prilagajanju zakonodaji. Prvi del naloge obsega ključna izhodišča in ozadje delovanja omenjene tehnologije ter smernice in omejitve splošne uredbe. V nadaljevanju je opisan praktični prikaz transakcije v Bitcoinovem omrežju blockchain, na podlagi katerega so vzpostavljene kritične točke naše problematike. Analiza slednjih je oblikovana z deskriptivno metodo in interpretacijo odgovorov, pridobljenih z izvedbo intervjujev. V zaključku so izpostavljene možnosti prilagoditve tehnologije blockchain za dosego skladnosti in predstavljene naše ključne ugotovitve. Temeljna prednost tehnologije blockchain je popolna sledljivost, kar predstavlja težavo, kadar se v sistemu blockchain obdelujejo osebni podatki. Za dosego skladnosti z določili splošne uredbe jih je treba iz omrežja umakniti in hraniti ločeno ali pa slediti možnostim prilagoditve tehnologije, s katerimi bi bilo mogoče spreminjati osebne podatke v verigi blokov.

Title:Analysis of blockchain technology compliance with General Data Protection Regulation
Abstract:Blockchain technology is described as one of the most important technological inventions in the past few years. Its breakthrough is the result of the popularity of cryptocurrencies. In addition to its uses in economy, it is being recognized in numerous other areas. It made its breakthrough at the same time as the General Data Protection Regulation (GDPR), which brought more rights to the citizens of the European Union for protecting their privacy. Based on the name of this regulation, it can be assumed that it includes general definitions, which make it more difficult to understand the obligations for processing personal data in blockchain systems. In this diploma thesis, we are researching the compliance of blockchain technology with the GDPR. The aim of this thesis is to ascertain if blockchain technology processes personal data and to what extent does this technology comply with the rules of the regulation, how it fights against data misuse and what does a possible need for compliance with the legislation mean for this technology. The first part of the thesis covers key points and the background of blockchain technology, as well as guidelines and limits of the GDPR. In the next part, we depict a practical demonstration of a transaction in a Bitcoin blockchain network, based on which we built the critical points for our issues. The analysis of the latter is devised with a descriptive method and an interpretation of answers, obtained through interviews. In the final part, we outlined the possibilities for the modification of blockchain technology for reaching compliance with the GDPR and presented our key findings. The main advantage of blockchain technologies is complete trackability, which presents a problem for when personal data is being processed in a blockchain system. To reach compliance with the rules of the GDPR, personal data should be removed from the network and stored separately, or possible modification should be followed and included on a regular basis, so that personal data in blockchains could be modified.
