Title:Javno dobro v slovenskem in hrvaškem pravu

Abstract:V magistrskem delu je predstavljena ureditev javnega dobra v slovenskem in hrvaškem pravu. Slovensko pravo pod pojem dobro uvršča zgolj javno dobro, medtem ko hrvaško pravo pod ta pojem uvršča javno dobro, splošno dobro in dobro v interesu Republike Hrvaške. Pod javno dobro v hrvaškem pravu spadajo zgolj stvari, ki so v lasti Republike Hrvaške, medtem, ko po slovenskem lahko spadajo tudi stvari, ki so v lasti oseb zasebnega prava. Značilnost javnega dobra je njegova splošna uporaba, kar pomeni, da ga lahko uporablja vsakdo. Mogoča pa je tudi njegova posebna uporaba na temelju koncesije ali na drugih pravnih temeljih. V magistrskem delu je podrobneje obravnavana koncesija na splošnem dobru, kamor po hrvaškem pravu spadajo stvari, na katerih ni mogoče pridobiti lastninske ali druge stvarne pravice. Osrednja tema magistrske naloge je predstavitev primerjave med obema sistemoma, ki obirata drugačen pristop pri opredeljevanju pojma javno dobro.

Title:Public good in slovenian and croatian law
Abstract:This Master's thesis presents the regulation of public good under Slovenian and Croatian law. The term »good« under Slovenian law refers only to public good, whereas the same term under Croatian law also encompasses general good and the good that is in the interest of the Republic of Croatia. Public good under Croatian law include only property owned by the Republic of Croatia, while the same concept under Slovenian law also includes property that is owned by private entities. General use is a typical feature of public good, which means that anyone may use public good. However, particular use of public good on the basis of a concession or other legal basis is also possible. The present Master's thesis deals specifically with concession on general good which under Croatian law, includes property that cannot be the subject of ownership or other proprietary rights. The main issue of this Master's thesis is the presentation of a comparison between the two systems, each of which takes a different approach to the definition of public good.
