Title:Rejniška pogodba: primerjava med Slovenijo in Hrvaško

Abstract:V Ustavi Republike Slovenije predstavlja starševstvo temeljno človekovo pravico vsakega posameznika. Ker rejništvo predstavlja enega izmed posegov v to pravico, je to institut, ki zahteva ažurno prilagajanje pravni ureditvi in tudi preverjanje v praksi. Otrok se v Republiki Sloveniji namesti v rejništvo, v kolikor nima svoje družine ali če iz kakšnih drugih razlogov ne more prebivati pri svojih starših. Preden pa lahko rejnik začne izvajati rejništvo, mora izpolniti določene pogoje in pridobiti dovoljenje za izvajanje rejništva, pri čemer je slovenska pravna ureditev zelo podobna hrvaški. V Republiki Sloveniji bo po novi zakonodaji poslej večjo vlogo pri odločanju o rejništvu imelo sodišče, medtem ko v hrvaški pravni ureditvi, to vlogo nosi še vedno center za socialno delo. Bistvo diplomskega dela, je v okviru postopka oddaje rejenca v rejništvo, sklenitev rejniške pogodbe, ki ima tudi določeno pogodbeno vsebino. Po hrvaški zakonodaji je ta vsebina širša, čeprav jo opredeljuje zgolj en zakon. Pomembno je poudariti tudi, da rejniško pogodbo na Hrvaškem sklene pristojni center za socialno delo na področju stalnega prebivališča rejnika in rejnik, pri nas pa pristojni center za socialno delo na področju stalnega prebivališča rejenca in rejnik. Naša zakonodaja glede rejništva je obsežnejša, vprašanje pa je ali je tudi boljša in učinkovitejša.

Title:Foster contract: comparing republic of Slovenia and republic of Croatia
Abstract:Parenthood represents one of the most important human rights in Slovenian constitution. As foster care is a violation of that human right, it must be adapted to the legal system and practised carefully. Child is put into the foster system if he does not have a family of his own or because for some reason, he can not stay with his parents. Foster parent has to meet certain conditions and needs a foster license. Slovenian arrangement is very similar to the one in Croatia. New legislation in Slovenia changed the role of court when deciding on whether the child is put into a foster home or not, while in Croatia this decision is made by the Centre of social services. My goal in this assignment is to describe the procedure of puting a child into the foster system and the fostering contract. In Croatia this contract is signed by the Centre of social services based on childs primary residence, and has a larger content matter than the Slovenian foster contract. Slovenian fostering legislation consists of more laws than Croatian, but the question is if it is also better and more effective.
