Title:Možnosti uporabe informacijsko - komunikacijskih sredstev v pravdnem postopku

Abstract:Danes nas v moderni družbi informacijsko-komunikacijska tehnologija spremlja na vsakem koraku, uporabo informacijsko-komunikacijskih sredstev jemljemo za samoumevno. Tako tudi na področju pravosodja ni nobene razlike in je zato z vse hitrejšim razvojem informacijsko-komunikacijske tehnologije, ta prodrla tudi na področje delovanja sodišč. Pravdni postopek je v Sloveniji urejen z Zakonom o pravdnem postopku, v okviru katerega zasledimo tudi določbe, ki omogočajo uporabo informacijsko-komunikacijskih sredstev v pravdnem postopku. Informacijsko-komunikacijsko tehnologijo lahko v okviru pravdnega postopka uporabimo v primeru vlaganja vlog na sodišče, pri čemer lahko to storimo elektronsko, sodišča lahko izrabijo tehnologijo kot pripomoček, s katerim ustvarijo elektronski zapisnik ali pa izvajajo dokaze s pomočjo videokonference. Sodišča lahko v postopkih (v primeru nepristojnosti, nudenja pravne pomoči in v postopkih s pravnimi sredstvi) med seboj komunicirajo elektronsko. Sodišče lahko na podlagi določb Zakona o pravdnem postopku opravlja vročanje pisanj s pomočjo informacijsko-komunikacijske tehnologije. Prav tako pa lahko sodišča uporabijo tehnologijo pri svojih končnih odločitvah in jih izdajo v elektronski obliki. S sprejetjem novele E Zakona o pravdnem postopku, pa je v določbe zakona prišlo tudi kar nekaj novosti, ki vlogo informacijsko-komunikacijske tehnologije še povečujejo oziroma ji dajejo še večji pomen, res pa je, da bo potrebno sedaj v praksi oblikovati sistem, ki bo lahko uresničil večjo (popolno) informatizacijo pravdnega postopka. S primerjavo slovenskih in avstrijskih določb, ki omogočajo uporabo informacijsko-komunikacijskih sredstev, njuna podobnost ne preseneča, saj se je slovenska pravna ureditev v veliki meri zgledovala po avstrijski ureditvi.

Title:Possibilities of using information - communication technology in civil procedure
Abstract:Today, in modern society, people use information and communication technology at every step. Use of information and communication technology is frequently taken for granted. Therefore, there is no difference in the area of justice. With the rapid development of information and communication technology, this has also penetrated the field of operation of the courts. Civil procedure in Slovenia is regulated by the Civil Procedure Act (Zakon o pravdnem postopku), which includes provisions that enable the use of information and communication technology in a civil procedure. Information and communication technology in civil proceedings can be used in the case of filing applications to the court, and this can be done electronically, courts may use technology as a device to create an electronic record or to provide evidence through videoconference. In proceedings (in the event of lack of jurisdiction, provision of legal assistance and legal proceedings), the courts can communicate electronically with each other. On the basis of the provisions of the Civil Procedure Act, the court may service documents by using information and communication technology. Also, the court may use technology in its final decisions and issued them in electronic form. Novel E of the Civil Procedure Act, brought a number of innovations that increase the role of information and communication technology, or give it even greater significance, but it is true that in practice, it will be necessary to create a system which will be able to realize a full computerization of the civil procedure. By comparing the Slovenian and Austrian provisions that enable the use of information and communication technology, their similarity is not surprising, because the Slovenian legal system was largely inspired by the Austrian legal system.
