Title:Zemljiškoknjižni vpisi v zvezi z razlastitvenimi postopki s pregledom sodne prakse

Abstract:Magistrsko delo obsega pregled celotnega postopka razlastitve, s katerim se prisilno odvzame ali omeji lastninsko pravico v korist države, lokalne skupnosti ali drugega subjekta javnega prava. Predmet razlastitve in omejitev lastninske pravice so lahko le nepremičnine. Z Ustavo RS so opredeljeni dopustni okvirji razlastitve, v skladu s katerimi se lastninska pravica na nepremičnini lahko odvzame ali omeji le na podlagi zakona, proti nadomestilu v naravi ali odškodnini ter pod pogojem, da je takšen poseg v javno korist. V skladu z zakonsko ureditvijo z razlastitvijo pride do popolnega odvzema lastninske pravice, medtem ko se v primeru omejitve lastninske pravice ta le delno odvzame. Lastninska pravica se lahko omeji s pravico začasne uporabe ali obremenitvijo z začasno ali trajno služnostjo. Institut razlastitve je v zakonski ureditvi predviden kot skrajni ukrep, ki se lahko uporabi izključno za izvedbo prostorskih ureditev, ki so v javno korist. Ob tem je potrebno zadostiti pogoju, da je takšna ureditev nujno potrebna in v sorazmerju s posegom v lastninsko pravico. Razlastitev je tako nedvomno najtežji poseg v lastninsko pravico kot eno temeljnih človekovih in premoženjskih pravic. V zvezi z razlastitvenimi postopki je potrebno upoštevati tudi zemljiškoknjižno pravo, saj predstavlja pomemben vidik na področju nepremičninskega prava. Pri pravnem prometu z nepremičninami je pomembno zlasti zanesljivo varstvo zaupanja v podatke, ki so vpisani v zemljiški knjigi, kot javni evidenci. Zemljiška knjiga je namreč namenjena vpisu in javni objavi podatkov o pravicah na nepremičninah in pravnih dejstvih v zvezi z nepremičninami. Z vpisi v zemljiško knjigo se tako zagotovi publiciteta podatkov, na podlagi katerih se je mogoče seznaniti s pravnim stanjem nepremičnin. Skozi obravnavo razlastitvenih postopkov so zato izpostavljene posebnosti zemljiškoknjižnega prava in zemljiškoknjižni vpisi na tem področju, vključno s pregledom aktualne sodne prakse.

Title:Land registry entries in expropriation procedures with a review of case law
Abstract:This master's thesis includes an overview of the entire expropriation procedure, in which the property right is forcibly seized or restricted in favor of a state, local community or other public-law entity. Only real estate may be the subject of expropriation and restrictions on property right. The Constitution of the Republic of Slovenia defines the permissible scope of expropriation, according to which the property right on immovable property can be withdrawn or restricted only on the basis of the law, for monetary compensation or compensation in kind, and provided that such an intervention is in the public interest. According to legal regulation, expropriation entails the complete deprivation of property rights, while in the event of restrictions of property rights, they are only partially withdrawn. The property right may be restricted by temporary right of use, or encumbrance with temporary or permanent easement. The institute of expropriation is seen as a last resort in the legislation, which can be used exclusively for the implementation of spatial arrangements that are in the public interest. In addition, it is necessary to satisfy the condition that such a regulation is indispensable and proportionate to the interference with the property right. Expropriation is thus undoubtedly the most significant intervention into property right as one of the fundamental human and ownership rights. When dealing with expropriation procedures, land registry law should also be taken into account, as it represents an important aspect in the field of real estate law. In legal transactions with real estate, it is particularly important to secure the protection of trust in the data entered in the land register, as it is part of public records. Namely, the land register is intended for registration and publication of data on real estate rights and legal facts relating to real estate. The entries in the land register thus ensure the publicity of the data, on the basis of which it is possible to gain information regarding the legal status of real estate. Since they are necessary to effectively examine expropriation procedures, specific features of land registry law and land registration, including a review of current case-law, are therefore included in the thesis.
