Title:Pravna ureditev orožja v Republiki Sloveniji in primerjalnopravno v Republiki Italiji in Republiki Hrvaški : magistrsko delo

Abstract:Magistrsko delo obravnava pravno ureditev osebnega oziroma civilnega orožja v izbranih primerjalnih modelih, to je v Republiki Sloveniji, Republiki Italiji in Republiki Hrvaški. Predstavljeni bodo temeljni orožni predpisi primerjanih oziroma obravnavanih držav in temeljni regionalni pravni viri (orožna zakonodaja, sprejeta v okviru Evropske unije), ki se nanašajo na področje orožja. Osrednji namen magistrskega dela je bralcu prikazati pogoje, ki jih morajo posamezniki izpolnjevati, da jim pristojni organi v obravnavanih pravnih sistemih lahko izdajo zahtevane orožne listine, na podlagi katerih so nato upravičeni do posesti strelnega orožja. Primerjalnopravna analiza obravnavanih pravnih sistemov poskuša posebej predstaviti zlasti pristojne organe, pooblaščene za odločanje v postopkih z orožjem, pravno ureditev lovskega, športnega in varnostnega orožja, nato še postopek v zvezi s podarjenim oziroma podedovanim orožjem, področje zbiranja orožja in končno način urejanja področja orožja, ki ga imajo v posesti zasebne varnostne službe. V zadnjem delu magistrskega dela so prikazani ključni predpisi Evropske unije na področju orožnega prava, ki določajo minimalne skupne pogoje za nabavo, posest in nošenje orožja, minimalno harmonizacijo in določene tehnične aspekte orožnega prava.

Title:Comparative legal regulation of firearms in slovenia, italy and croatia
Abstract:The Master's thesis analyses the legal regulation on personal or civil firearms set up in Slovenia, Italy and Croatia. The thesis presents fundamental firearms regulations in the selected comparative models and fundamental regional regulations (Directive 91/477/EEC and Directive 2008/51/EC) about firearms. Central purpose of the Master's thesis is to display to the reader the requirements that must be met by the individuals in order to ensure that government authorities of jurisdiction in the legal systems in question are able to issue firearm licenses, that allow the licensee to buy, possess or carry a firearms. The analysis of comparison of the legal systems that are shown in the Master's thesis tries to display the competent authorities to take decisions about firearms acquisition and possession. It also describes the legal regulation regarding the owning of hunting, sport’s and self-defence firearms. Then it shows the process regarding the donated, inherited and collected firearms. Finally, it describes the way which regulates the system of firearms owning by the private security agencies. In the last part of the Master’s thesis are described the key firearms regulations at the European Union level. That regulations established minimum common requirements for acquisition, possession and carrying firearms. The European Union Directives also established the minimum of the harmonization between European Union members and some technical aspects of firearms legal regulation.
