Title:Razpolaganje s stvarnim premoženjem države in občin

Abstract:Država in občine kot temeljne samoupravne lokalne skupnosti imajo v lasti tako po številu kot tudi po vrednosti obsežno stvarno premoženje. Med stvarno premoženje pa prištevamo tako premičnine kot nepremičnine. Zaradi obsežnosti stvarnega premoženja je predpogoj preudarno in gospodarno ravnanje. Enovita zakonodaja je tako nujen pogoj, da se sistematično in enovito uredi postopke pridobivanja, razpolaganja in upravljanja s stvarnim premoženjem države in samoupravnih lokalnih skupnosti ter pripomore h gospodarnejšem in bolj transparentnem upravljanju in razpolaganju s stvarnim premoženjem države in samoupravnih lokalnih skupnosti. Še vedno, kljub sprejetem Zakonu o stvarnem premoženju države in samoupravnih lokalnih skupnosti ter Uredbe o stvarnem premoženju države in samoupravnih lokalnih skupnosti, ki sta skupaj zelo pripomogla k sistematičnem normativnem urejanju na področju stvarnega prava v lasti države in samoupravnih lokalnih skupnosti, je po podatkih Geodetske uprave Republike Slovenije na seznamu upravljavcev nepremičnin vpisanih več kot 450 upravljavcev nepremičnega premoženja Republike Slovenije, kar ima za posledico neenotnost in nepreglednost ravnanj ter tako onemogoča usklajeno in gospodarno nepremičninsko politiko. Po mojem mnenju kljub razmeroma enoviti in sistematsko dobro urejeni zakonodaji, imamo razmeroma nizko realizacijo letnega načrta ravnanja, ki pa zopet mislim da ne gre govoriti zgolj o objektivnih okoliščinah in opravičevati dejstvo nizke realizacije na podlagi nizke gospodarske rasti, saj menim da se le-ta odraža zgolj deloma. Poraja se vprašanje ali upravljavci nepremičnine, ki jih trajno ne potrebujejo, ''na zalogo'' uvrščajo v letne načrte, in sicer za primer ko bi se kupec ali poslovna priložnost morebiti v določenem letu vendarle pojavila.

Title:Disposal of tangible property of the state and municipality
Abstract:The state and local self-government communities, own both the number and the value of real property. Real property includes both movable and real estate property. Due to the scale of real assets, a prerequisite is prudent and economical. Uniform legislation is thus a necessary condition for systematically and uniformly regulating the procedures for obtaining, disposing and managing the real assets of the state and local self-government communities, and contributing to more efficient and more transparent management and disposal of real assets of the state and local self-government communities. Despite the adoption of the Act on the Real Property of the State and local Self-Government Communities and the Regulation on the Real Property of the State and local Self-Government Communities, which together have greatly contributed to systematic normative regulation in the field of substantive law owned by states and local self-government communities, according to the Geodetic Survey of the Management Board of the Republic of Slovenia on the list of real estate managers entered more than 450 managers of real property of the Republic of Slovenia, which results in an uneven and opaque behavior, thus preventing a coordinated and economical real estate policy. Despite the relatively uniform and systematically well-regulated legislation, I still have a relatively low realization of the annual plan of conduct, which again I think that it is not just about objective circumstances and to justify the fact of the low realization on the basis of low economic growth, as I believe that it reflects only partially. The question arises whether real estate managers who do not need them permanently "put into stock" into annual plans, for example when a buyer or business opportunity would possibly have appeared in a particular year.
