Title:Glavna obravnava - načelo javnosti in koncentracije

Abstract:Diplomska naloga obravnava eno izmed najpomembnejših faz civilnega pravdnega postopka, glavno obravnavo in dve temeljni načeli, ki prideta na glavni obravnavi še posebej do izraza. To sta načelo javnosti in načelo koncentracije postopka. Vsako izmed obeh načel je v diplomski nalogi podrobno analizirano, in predstavljeno tudi skozi aktualno novelo ZPP-E. S pomočjo strokovne literature, sodne prakse, zakonov in tudi nekaterih, za to temo pomembnih internetnih virov, pa je razložen tudi sam pomen glavne obravnave skozi spremembe, ki jih je prinesla že prej omenjena novela. V povezavi z načelom javnosti so opisani primeri, v katerih pride do izključitve le te. Veliko pozornosti pa sem namenila predvsem novelirani ureditvi nekaterih institutov, ki so posredno povezani s tem načelom. Drugo posebno načelo pravdnega postopka, ki ga zajema ta diplomska naloga, pa je načelo koncentracije postopka. V diplomski nalogi sem predstavila sam razvoj tega načela skozi različne novele Zakona o pravdnem postopku. Poudarek pa je na trenutno aktualni ureditvi načela po noveli ZPP-E. Na kratko sem omenila tudi pomen omenjenega načela v posebnih postopkih in opisala posledice kršitve načela.

Title:Main hearing - the principle of publicity and concentration
Abstract:The thesis work deals with one of the most important stages of the civil litigation process, the main hearing and two basic principles, which becomes especialy noticible in main hearing. These are the principle of publicity and the principle of concentration. Each one of these two principles is analyzed and also presented through the current amendment ZPP-E . With the help of proffesional literature, case law, legislation, and also some important internet sources, I explain the meaning of the main hearing itself and its changes through amendment ZPP-E. In connection with the principle of publicity there are described some of the examples which can lead to exclusion of publicity. I devoted a great deal of attention to the revised regulation of some institutes that are indirectly related to this principle. The second specific principle of the litigation procedure that is covered with this thesis is the principle of concentration. I presented the developement of this principle throughout various amendments of Civil Procedure Act. The emphasis in connection to this principle, is on the current regulation of the principle, according to the ZPP-E. I briefly mentioned the imporrtance of this principle in special procedures and I also described the conseqences of the violation of the principle.
