Abstract:V diplomskem delu so predstavljeni civilnopravni vidiki presoje predpostavk za pridobitev pravice do rokovanja z orožjem. Temeljno vodilo pri sklepanju pravnih poslov v zasebnem pravu je svobodna volja pogodbenih strank. Avtonomija volje pa v nekaterih pogodbenih razmerjih trči ob zakonske omejitve volje, ki se jim stranke ne morejo ogniti. Pravni posli z orožjem so podvrženi takšnim omejitvam, ki jih prinašajo predpisi iz tako imenovane orožne zakonodaje. Zakon o orožju nam daje vpogled v razvrstitev in kategorizacijo orožja, vrste in pomen orožnih listin, pristojnosti državnih organov ter v pravice in obveznosti posameznikov, ki rokujejo z orožjem. Spoznali smo kakšne so splošne in posebne predpostavke pri sklepanju pravnih poslov ter njihov vpliv na avtonomijo volje.

Abstract:The diploma thesis presents civil law aspects of the requirements for obtaining the right to handle with firearms. In concluding legal transactions in private law, a free will of contracting parties is a fundamental principle. However, in some contractual relationships, free will by law collides with legal restrictions of will which the parties can not avoid. Firearms transactions are subject to such limitations posed by regulations oft he so-called firearms legislation. Firearms Act gives us an insight into the classification and categorization of firearms, types of firearms documents and their meaning, jurisdiction of the national authorities as well as rights and obligations of individuals handling with firearms. The thesis therefore presents general and special requirements for concluding legal transactions and their impact on free will.
