Abstract:Magistrsko delo z naslovom "Pravica do pokojnine" preko podrobne analize odločb Ustavnega sodišča Republike Slovenije obravnava številna v praksi sporna vprašanja, ki se nanašajo na ureditev pravice do pokojnine. Prvi del magistrskega dela se nanaša predvsem na socialno varnost in na njeno vsebinsko opredelitev, saj je le-ta bistvenega pomena za uresničevanje ustavne človekove pravice do socialne varnosti, vključno s pravico do pokojnine. Poleg tega pa je v tem delu opredeljen še sam pojem pokojnine skupaj s splošnimi značilnostmi. Osrednji del magistrskega dela se osredotoča na pravico do pokojnine kot ustavno človekovo pravico. Namenjen je obravnavi v praksi spornih vprašanj, ki se nanašajo na ustavnopravno jedro pravice do pokojnine, na njeno ustavnopravno varstvo, na dopustnost posegov v pričakovane in pridobljene pravice z vidika prave in neprave retroaktivnosti, v zvezi s čimer so predstavljene tudi pomembnejše odločbe Ustavnega sodišča Republike Slovenije, na višino pokojnine ter na dopustnost spreminjanja višine pokojnine, odmerjene s pravnomočno odločbo, izpostavljene pa so tudi posebnosti v zvezi s pravnimi sredstvi in vloga države pri delovanju obveznega pokojninskega in invalidskega zavarovanja. Ustavno sodišče Republike Slovenije je do sedaj sprejelo mnogo meritornih odločitev s področja socialne varnosti, na koncu pa je izpostavljena zadeva U-I-264/2013, o kateri je Ustavno sodišče Republike Slovenije odločilo v tem letu in pri obravnavanju katere se je izoblikovalo mnogo različnih stališč.

Title:THE RIGHT TO PENSION
Abstract:Master's thesis entitled "The right to pension" through a detailed analysis of the decisions of the Constitutional Court of the Republic of Slovenia presents a number of contentious issues that are related to the regulation of the right to pension. The first part of the thesis refers to social security and its content, since it is essential for the realization of the constitutional human right to social security, including the right to pension. The thesis also defines the term "pension" and its general characteristics. The core part of the thesis focuses on the right to pension as a constitutional human right. It deals with contentious issues that are referring to a constitutional core of the right to pension and its constitutional protection. It also deals with the admissibility of interventions of the rights from the perspective of true retroactivity and quasi-retroactivity in connection with which also presents important case law of the Constitutional Court of the Republic of Slovenia. Contentious issues are also related to the height of the pension and to the admissibility of changing the height of pension which is determined by the final decision. The thesis also exposes the specific features associated with legal remedies and the state's role in the functioning of the compulsory pension and disability insurance. So far the Constitutional Court of the Republic of Slovenia has adopted many substantive decisions in the field of social security. One of the last is decision in case U-I-264/2013 on which we have many different views that are also presented in the Master's thesis.
