Title:DACHAUSKI PROCESI V SLOVENIJI IN SODNA REHABILITACIJA OBSOJENIH

Abstract:Namen diplomskega dela je predstaviti eno najmračnejših obdobij slovenske politične in posledično tudi pravne zgodovine, tj. obdobje dachauskih procesov v Sloveniji. Diplomsko delo je zasnovano na način, da je najprej splošno opisano taborišče Dachau: organizacija in delovanje taborišča. Nato se vsebina diplomskega dela nadaljuje v prikaz povojnega obdobja v Sloveniji ter opis povojnega »revolucionarnega« prava oz. t.i. obdobja »brezpravja«, ki je bila podlaga izvedbi dachauskih procesov v Sloveniji. Dachauski procesi kot montirani politični procesi so v diplomskem delu predstavljeni preko najpomembnejših zgodovinskih dejstev in dogodkov v obdobju po vojni. Opisan je takratni upravni aparat, vključno s sodstvom. Zadnji del diplomskega dela je namenjen raziskavi uporabe kazenskega materialnega in kazenskega procesnega prava v dachauskih procesih ter zlorabi le-tega s strani takratne oblasti. Konec diplomskega dela se zaključi z ugotovitvami o sodni in politični rehabilitaciji obsojenih v dachauskih procesih v Sloveniji. Za pripravo diplomskega dela je bila uporabljena slovenska in tuja literatura, ki je navedena na koncu diplomskega dela, in ki je bila študirana in raziskovana z uporabo opisne oz. deskriptivne metode s študijo literature, z zgodovinsko metodo preko preučevanja preteklosti in znanih dejstev na nivoju opisovanja in razlaganja ter s pomočjo metode analize in sinteze preko preučevanja kazenskega prava pri izvedbi dachauskih procesov, sodb in zaključkov le-teh.

Title:THE DACHAU'S TRIALS IN SLOVENIA AND THE JUDICIAL REHABILITATION OF CONVICTS
Abstract:The aim of this final paper is to present one of the darkest periods of Slovenian political and, consequently, legal history – the period of Dachau trials. This final paper first describes the Dachau camp in general – camp organization and operation. After that, it illustrates the post-war period in Slovenia and describes the post-war “revolutionary” law or the period of “lawlessness”, which led to the execution of Dachau trials in Slovenia. Dachau trials as show political trials are presented through the most important history facts and events of the post-war period. The administration apparatus of the time, including the judiciary, is also described. The last part of the final paper is intended to study the application of substantive criminal law and criminal procedural law in the Dachau trials and its abuse by the authorities of that time. The final paper is concluded with findings on the judicial and political rehabilitation of those convicted in the Dachau trials in Slovenia. For the preparation of this final paper, Slovenian and foreign literature was used, which is listed at the end of the final paper. The literature was studied and researched using the descriptive method through the study of literature, the historical method through the study of the past and known facts at the level of describing and explaining, and the method of analysis and synthesis through the study of criminal law in the execution of the Dachau trials, judgments and their conclusions.
