Title:USKLADITEV ZEMLJIŠKOKNJIŽNEGA STANJA Z DEJANSKIM, KI TEMELJI NA KONKRETNEM PRIMERU

Abstract:S posadno listino se opredeljuje listina o uskladitvi zemljiškoknjižnega stanja, saj zaradi določenih pravnih dejstev knjižno stanje ne ustreza resničnemu pravnemu stanju. Z novelo ZZK-1C je bil 40. člen dopolnjen z novim tretjim odstavkom, po katerem se za zemljiškoknjižno dovolilo šteje tudi listina, ki vsebuje izjavo osebe, ki jo izstavlja, da priznava izvirno pridobitev stvarne pravice v korist druge osebe (posadna listina) ali zaradi uskladitve zemljiškoknjižnega stanja z dejanskim ali zaradi nadomestitve izgubljenih listin dovoljuje vpis lastninske pravice ali druge pravice v korist druge osebe. S posadno listino zemljiškoknjižni lastnik priznava izvirno pridobitev stvarne pravice v korist druge osebe, z listino o uskladitvi zemljiškoknjižnega stanja z dejanskim pa se nadomešča pravno poslovni prenos. Razlika je v tem, da je izvirna pridobitev neodvisna od pravnega prednika, zato izda takšno listino z zemljiškoknjižnim dovolilom tisti, ki je vpisan v zemljiško knjigo kot lastnik, pa dejansko to ni, in v posadni listini prizna dejstva priposestvovanja osebi, ki ji priznava stvarno pravico in zato dovoljuje vpis nanjo. V drugem primeru pa je potrebno upoštevati načelo pravnega prednika . Tudi ko je podlaga za vpis v zemljiško knjigo ena izmed teh listin, morajo biti upoštevani vsi pogoji, ki so po ZZK-1 potrebni za overitev zemljiškoknjižnega dovolila. V obeh primerih mora biti listini priloženo tudi potrdilo o namenski rabi nepremičnine, oziroma v primeru, ko gre za nepremičnino, ki je glede na namen rabe podvržena ureditvi po drugih prisilnih predpisih, tudi soglasje ali odobritev pristojnega organa oziroma potrdilo, da takšno soglasje ali odobritev ni potrebna.

Title:HARMONIZATION OF THE FACTS FROM THE LAND REGISTRY AND THE ACTUAL FACTS
Abstract:In Slovenian legal order we have a special document which defines a document that harmonize the facts that are registered in Land Registry and the actual facts. With the novel of the Law of the Land Registry there was an amendment of Article 40. The amendment requires that for the document of the land register permission is enough to submit the document which contains testimonial from the person who wants to register the right in rem for the benefit of another person. It also requires the same thing when it comes to the harmonization of facts from the Land Register and the actual facts or when the document is lost. In the first case the registered owner of the land or any other right in rem acknowledges the original acquisition of this right. While the second case is replacing the legal business transfer. The original acquisition is not depending on the legal predecessor. In this case a person who can issues the document of the land register permission is the one who is registered in that document as owner, but in fact he is not. So the parties must conclude an agreement where the person that is registered as owner allows other party to become an owner and also allows the registration of that other party to enrol in the Land Registry. Regardless of this facts all the conditions must be fulfilled for authorization to Land Registry. In both cases a certificate of the land use property must be attached.
