Title:PODELJEVANJE DRŽAVLJANSTEV DRŽAV ČLANIC EVROPSKE UNIJE NA PODLAGI INVESTICIJSKIH SHEM KOT OBLIKA DISKRIMINACIJE

Abstract:Diplomska naloga obravnava problematiko podeljevanja državljanstev na podlagi investicijskih shem in s tem povezano diskriminacijo. Nacionalno državljanstvo znotraj Evropske unije (EU) vljučuje tudi državljanstvo EU. Sodišče EU v sodni praksi širi obseg pravic iz naslova državljanstva EU, sprva je pravice priznavalo le ekonomsko aktivnim osebam, kasneje vključi tudi pravice socialne narave. V letih po finančno-gospodarski krizi so zaradi primanjkljajev v proračunih nekatere države znotraj EU sprožile posebne investicijske programe, v skladu s katerimi v zameno za finančne vložke v proračune držav podeljujejo državljanstva, med tovrstnimi državami sta tudi Malta in Ciper. Običajno so programi nedorečeni in ne zajemajo pogoja pristne vezi med državljanom in državo. Investicijski programi rušijo zaupanje med državami članicami, saj država, ki odobri državljanstvo, pobere koristi, preostale države članice pa bodo morda v skladu z načelom nediskriminacije in pravico do prostega gibanja morale prevzeti bremena. Diplomska naloga izpostavlja, da pomanjkanje kriterijev pri podeljevanju državljanstev kaže na diskriminacijo v odnosu do prosilcev za državljanstvo, ki morajo skozi dolgotrajne postopke naturalizacije, v katerih morajo izkazati znanje jezika, poznavanje običajev ter prebiti določeno obdobje na ozemlju države v kateri vlagajo prošnje. Diplomska naloga zaključuje, da je zgolj finančni kriterij pri podeljevanju državljanstev nezadosten, saj se ne ustvari pristna vez med državljanom in državo, tematika pa postaja aktualna tudi v luči migrantske oziroma begunske krize, ko na zunanjih mejah EU čakajo množice prosilcev za azil.

Title:BECOMING EU CITIZEN BASED ON INVESTMENT SCHEMES AND ROLE OF DISCRIMINATION
Abstract:This diploma thesis explores issues on selling citizenship based on investment schemes programmes and the perspecitive of discrimination. National citizenship comes in package with citizenship of the Union. Court of Justice of the European Union is a key player in interpreting the term citizenship of the Union. In courts decisons we can see developement and expansion of entitlements included in citizenship of the Union. After the beginning of world financial crisis several countries in European Union started selling citizenships. If a third-country national wanted to acquire maltese or cyprus citizenship he or she only needed to invest large sum of money in states economy. Often citizenship by investment programmes do not include process of naturalisation, consequently there is no genuine link created between country and a citizen. Citizenship by investment programmes also ruin the sincere cooperation between state members because on one hand while some countries collect profits, others might cover the expenses. This diploma thesis points out that lack of criteria, rather than financial criteria in selling citizenship, shows that there exists discrimination towards those applicants for citizenship that do not have financial resources and have to go through difficult process of naturalisation. Problem is also very intereseting in the context of refugee or migrant crisis that European Union deals with in present. This diploma thesis conludes that only financial criteria is unsufficient, because there is no genuine link created between citizen and the state.
