Abstract:Ustaljena in enotna sodna praksa ni enaka pomenu pojma precedens kot ga interpretirajo v anglo-ameriškem pravnem sistemu, kjer velja za formalni pravni vir, vendar se mu zelo približuje. Le ta v zadnjem času postaja vedno pomembnejši pravni vir, nekateri teoretiki enotno in ustaljeno sodno prakso zelo približujejo pomenu kot ga imajo formalni pravni viri v slovenskem pravu. Ko primerjamo en in drug sistem med seboj, bi sicer lahko zaključili, da ima glede pojma precedens in ustaljene sodne prakse, vsak od njiju svoje prednosti in slabosti, pa vendar ni mogoče pravila enega sistema prenašati v drugega. V diplomskem delu bo predstavljen pojem precedens, ustaljena in enotna sodna praksa, vloga Vrhovnega in Ustavnega sodišča RS v razmerju do sodne prakse ter institut ustavne pritožbe.

Title:PRECEDENT IN THE SLOVENIAN LAW
Abstract:Stable and uniform case law does not have the same meaning as the concept precedent as is interpret in Anglo-American legal system, were it applies as formal source of law, but it's getting very close to it. Precedent is gettin more and more important with the time as the source of law, some theoreticians are putting stable and uniform case law closer to the meaning of the formal sources of law in Slovenian legal system. When we compare both systems with each other, we could conclude that the concepts precedent and stable case law, both have their own advantages and disadvantages, but still you can not transfer the rules of one legal system in to the other. In diploma thesis I will present the concepts precedent, stable and uniform case law, the role of the Supreme and Constitutional Court of the Republic of Slovenia in relation to the case-law and the institution of a constitutional complaint.
