Abstract:Pri programu zvestobe gre za obliko prodaje, s pomočjo katere ponudnik blaga in storitev zbere čim več podatkov o svojih kupcih ter jim nato na podlagi analize teh podatkov ponudi tiste izdelke, za katere meni, da jih najbolj potrebujejo oziroma si jih želijo. Da je program čim bolj privlačen za kupce in v njih vzpodbudi željo po včlanitvi, izvajalci programa oblikujejo različne sisteme nagrajevanja, s pomočjo katerih nato skušajo vplivati na obseg osebnih podatkov, ki jim jih bodo kupci zaupali. Temelj programa zvestobe tako predstavljajo zbirke osebnih podatkov, ki so pravno varovana kategorija, zato mora izvajalec programa pri zbiranju podatkov spoštovati sklop pravnih pravil, ki urejajo varstvo osebnih podatkov. Izvajalec programa mora poskrbeti, da osebne podatke zbira in obdeluje v skladu s temeljnimi načeli varstva osebnih podatkov, to so načelo poštenosti in zakonitosti ter načelo sorazmernosti, saj je vsaka obdelava v nasprotju s temi načeli nedopustna. Upoštevati mora pravila o pravni podlagi za obdelavo, ki jo predstavlja soglasje posameznika in pravila o namenu obdelave, ki mora biti določen pred začetkom zbiranja. Pri zbiranju in nadaljnji obdelavi pa mora spoštovati tudi pravice, ki jih ima posameznik, katerega podatki se zbirajo in obdelujejo. Posameznik ima tako pravico biti seznanjen o tem, kdo o njem zbira podatke in katere, obenem pa ima tudi pravico, da prepove zbiranje in obdelavo podatkov, da zahteva izbris, dopolnitev, popravek ali blokiranje že zbranih podatkov. Zakonodaja daje posamezniku tudi pravico do sodnega varstva v primeru kršitev njegovih pravic kakor tudi v primeru nezakonitega zbiranja in obdelave podatkov. Ker gre pri osebnih podatkih za občutljivo pravno kategorijo, pravo zahteva od izvajalca programa, kot uporabnika osebnih podatkov, tudi učinkovito zavarovanje osebnih podatkov.

Title:PROTECTION OF PERSONAL DATA IN CUSTOMER LOYALTY PROGRAMS
Abstract:Customer loyalty program is a form of marketing strategy that helps the trader to gather as much personal data as possible about his customers and following the side analysis, he creates the optimal offer according to customer’s specific wishes and needs. That the program is more attractive for buyers and also encourage them for join the program, performers of the program develop different systems of rewarding, with which they try to impact on the amount of forwarded personal data. The foundation of the loyalty program is the collection of personal data, which is a legally protected category and therefore requires from the performer of the program to, when gathering data, respect assembly of data protection rules. Performers of loyalty program must ensure that the collection and processing of personal data is in accordance with the basic principles of the protection of personal data. Those principals are the principle of fairness, legality and the principle of proportionality, and each way of processing against any of these principles is inadmissible. They must take into account the rules of the legal standing for processing, that is consent of the individual, and the rules on the purpose of processing, which must be determined before collecting personal data. In collecting and further processing, they must also respect the rights of the individuals whose data is being collected and processed. An individual has the right to be informed about who is collecting their data and which data is being collected. At the same time they have the right to forbid collecting and processing of data, to request deletion, update, correction or blocking already collected data. The legislation gives an individual the right to judicial protection of their rights, when they are being violated as well as in the case of illegal collection and processing of data. Personal data represent a delicate legal category, which is why the law requires from the performer of the program, as they are the user of personal data, effective insurance of personal data.
