Abstract:Diplomska naloga natančneje obravnava Direktivo 2011/95/EU o standardih glede pogojev, ki jih morajo izpolnjevati državljani tretjih držav ali osebe brez državljanstva, da so upravičeni do mednarodne zaščite, glede enotnega statusa beguncev in oseb, upravičenih do subsidiarne zaščite, in glede vsebine te zaščite, t.i. Kvalifikacijska direktiva. Slednja je izjemnega pomena z vidika skupnega evropskega azilnega sistema, saj je prvi naddržavni instrument, ki hkrati ureja zaščito beguncev in zaščito oseb, upravičenih do subsidiarne zaščite. Njen namen je predvsem prispevati k nadaljnji uskladitvi nacionalnih pravnih pravil držav članic iz tega področja, zvišati standarde zaščite ter odpraviti nejasnosti in dvoumnosti njene predhodnice, tj. Direktive 2004/83/ES. V nalogi je predstavljena vsebinska ureditev Direktive 2011/95/EU, s poudarkom na posameznih členih, ki so bili oziroma niso bili spremenjeni v postopku prenovitve Direktive 2004/83/ES.

Title:Conditions required for obtaining refugee status or subsidiary protection status under European Union law
Abstract:This diploma paper deals more specifically with the Directive 2011/95/EU on standards for the qualification of third-country nationals or stateless persons as beneficiaries of international protection, for a uniform status for refugees and persons eligible for subsidiary protection, and for the content of the protection granted, the so-called Qualification Directive. The latter is of utmost importance from the perspective of the Common European Asylum System, as it is the first transnational instrument, which at the same time regulates the protection of refugees and the protection of persons eligible for subsidiary protection. Its purpose is primarily to contribute to further harmonization of national legislation of the Member States, to raise the standards of protection and to remove the vagueness and ambiguity of its predecessor (ie. Directive 2004/83/EC). The paper presents the content of Directive 2011/95/EU, with emphasis on individual Articles that have or have not been amended in the recast process of Directive 2004/83/EC.
