Title:RAZLIKOVANJE MED POSREDNIMI IN NEPOSREDNIMI IMISIJAMI S PREGLEDOM SODNE PRAKSE

Abstract:Imisije predstavljajo enega najtipičnejših institutov (stvarnega) sosedskega prava, ki je v Sloveniji oblikovano kot zakonska omejitev lastninske pravice. V začetnem poglavju so tako na kratko predstavljeni pojem lastninske pravice, njen razvojni premik od stroge absolutnosti do njene današnje socialne vezanosti in njena pozitivnopravna ureditev. Sledi predstavitev pojma sosedskega prava, našteti so viri sosedskega prava in podrobneje predstavljeno zasebno sosedsko pravo v Stvarnopravnem zakoniku in Obligacijskem zakoniku. Osrednji del diplomskega dela je namenjen stvarnopravni ureditvi imisij, od koder tudi izvira delitev imisij glede na način vplivanja na posredne in neposredne. Opredeljen je pojem imisij, zaradi lažjega razumevanja sodne prakse in prikaza spremembe v vsebinski opredelitvi imisij pa je prikazana tudi ureditev imisij v Občem državljanskem zakoniku in Zakonu o temeljnih lastninskopravnih razmerjih. Podana je klasifikacija imisij in v tem okviru tudi opredeljeno razlikovanje med posrednimi in neposrednimi imisijami z vidika pravne teorije in sodne prakse. Razloženi so pravni standardi posrednih imisij in predstavljeno je stvarnopravno varstvo pred imisijami, ki se uveljavlja z negatorno tožbo. V slovenskem pravu civilnopravna ureditev imisij temelji na dveh pravnih podlagah, klasični stvarnopravni in obligacijskopravni. Obe pravni podlagi se pomembno dopolnjujeta in ju je treba razumeti v medsebojni povezavi. Iz tega razloga je predstavljeno tudi obligacijskopravno varstvo pred imisijami in drugimi oblikami povzročanja škode, škodne nevarnosti in nedopustnega vznemirjanja. Ponovno je poseben poudarek na razlagi pravnih standardov. V zadnjem poglavju je predstavljeno razmerje med obema oblikama zasebnopravnega imisijskega varstva.

Title:THE DISTINCTION BETWEEN INDIRECT AND DIRECT IMMISSIONS WITH A REVIEW OF THE CASE LAW
Abstract:Immissions (nuisances) are one of the most typical institutes of the neighbour (property) law that is in Slovenia regulated as the legal limitation of the property right. The opening section provides a short introduction into the concept of property rights, its development from a strict absolute nature to today’s social connection, as well as its coherent legal status. It is followed by the introduction into the concept of the neighbour law, a list of the legal sources of the neighbour law, and a more detailed description of the private neighbour law in the Slovenian Law of Property Code as well as Code of Obligations. The core of the thesis is dedicated to how immissions are regulated from the point of view of property law, which is also the source of their classification into indirect and direct with regard to their type of effect. The definition of immissions is provided, however in order to provide an easier understanding of the case law and to demonstrate the changes in the definition of immissions, also the regulation of immissions in the General Civil Code and the Basic Property Law Relations Act is shown. Also the classification of immissions is listed in order to allow the distinguishing between indirect and direct immissions from the viewpoint of legal theory and case law. An explanation of legal standards of indirect immissions is provided as well as the property law protection from immissions enforced through actio negatoria. In our legal system, the immissons as regulated by the civil law are based on two legal bases, i.e. the standard property law and the law of obligations. Both are complementary to one another and shall be understood within the context of their connection. Therefore also the protection from immissions and other forms of inflicting damage, damage risk and intolerable disturbance from the viewpoint of the law of obligations is demonstrated. Once again, there is an emphasis on the explanation of legal standards. The last chapter demonstrates the relationship between both forms of protection from immissions, stipulated in the private law.
