Title:PRAVNOPOLITIČNI POLOŽAJ NEMŠKE MANJŠINE NA POLJSKEM Z VIDIKA MEDNARODNEGA PRAVA

Abstract:Magistrska naloga se osredotoča na pravnopolitični položaj nemške manjšine na Poljskem z vidika mednarodnega prava. V uvodu predstavi problem bega in izgona Nemcev ob koncu druge svetovne vojne, ter s tem povezan problem Potsdamske konference, v luči že tedaj veljavne IV. Haaške konvencije o zakonih in običajih vojne na kopnem iz leta 1907. Naloga se v nadaljevanju osredotoča na pravnopolitični položaj preostale nemške manjšine na Poljskem v času po koncu komunističnega režima. V tem smislu obravnava jezikovne pravice na področju šolstva, medijev, dvojezične označbe krajev, rabe jezika pred upravnimi oblastmi, pravico do politične soudeležbe in verske pravice. Temu sledi ocena skladnosti z obveznostmi, kot izhajajo iz mednarodnih dokumentov, h katerim je pristopila Poljska na področju varstva manjšinskih pravic. V ta namen obravnava implementacijo naslednjih dokumentov: Mednarodne konvencije o odpravi vseh oblik rasne diskriminacije, Mednarodnega pakta o državljanskih in političnih pravicah (člen 27), Deklaracije o pravicah pripadnikov narodnih ali etničnih, verskih in jezikovnih manjšin, skladnost z načeli priporočil/smernic v okviru OVSE, Okvirne konvencije za varstvo narodnih manjšin, Evropske listine o regionalnih ali manjšinskih jezikih, Protidiskriminacijske direktive 2000/43/ES. Predstavljen je problem odsotnosti pristopa k Protokolu št. 12 k Evropski konvenciji o varstvu človekovih pravic. Na koncu so predstavljeni zaključki in predlogi v smeri boljše implementacije obravnavanih instrumentov.

Title:Legal and political situation of German Minority in Poland from the perspective of international Law
Abstract:The focal point of this master thesis is the examination of legal and political situation of the German minority in Poland from the perspective of international law. The thesis starts by examining the flight and expulsion of Germans after the Second World War, touching on the problem of Potsdam conference in light of the 1907 Hague Convention (IV) Respecting the Laws and Customs of War on Land and its Annex. Discourse then focuses on the legal and political situation of the remaining German minority in Poland after the end of Communist rule. In this sense, linguistic rights in the area of education, media, administration, topography, right to political participation and religious rights are discussed. Subsequently the current state of affairs is examined in view of the existing international law obligations in the field of minority protection recognized by Poland. In this regard the implementation of following international documents is studied: International Convention on the Elimination of All Forms of Racial Discrimination, International Covenant on Civil and Political Rights (article 27), Declaration on the Rights of Persons Belonging to National or Ethnic, Religious and Linguistic Minorities, the German-Polish agreement on good neighborliness and friendly cooperation, recommendations/guidelines in the framework of OSCE, Framework Convention for the Protection of National Minorities, European Charter for Regional or Minority Languages and the Equality directive 2000/43/EC. The problem of failure to accede to Protocol No.12 to European Convention on Human Rights is introduced. At last, conclusions and suggestions for enhanced implementation of international obligations are presented.
