Title:Ukinitev državnega organa kot razlog za prenehanje pogodbe o zaposlitvi

Abstract:Magistrska naloga obravnava prenehanje pogodbe o zaposlitvi državnim javnim uslužbencem iz poslovnega razloga, s poudarkom na prenehanju pogodbe zaradi ukinitve državnega organa po drugem odstavku 153. člena Zakona o javnih uslužbencih (ZJU). Glede na posebno ureditev po ZJU, da javnemu uslužbencu lahko preneha pogodba o zaposlitvi zaradi ukinitve državnega organa in se pri tem uporabljajo določbe, ki veljajo za prenehanje pogodbe o zaposlitvi iz poslovnega razloga, je obravnavana tudi odpoved pogodbe o zaposlitvi javnemu uslužbencu iz poslovnega razloga, kot enem od razlogov odpovedi pogodbe o zaposlitvi. Temeljiteje je proučevan javnofinančni razlog odpovedi, ki ga navedeni zakon razvršča med poslovni razlog odpovedi. Kljub temu, da se je glede načinov prenehanja pogodbe o zaposlitvi položaj javnih uslužbencev po noveli ZJU iz leta 2005 zelo približal položaju delavcev v zasebnem sektorju, še vedno velja prepričanje, da je stopnja varnosti zaposlenih v javnem sektorju višja od stopnje varnosti zaposlenih v zasebnem sektorju. Iz podatkov v magistrski nalogi izhaja, da je število odpovedi iz poslovnega razloga s strani delodajalca v zasebnem sektorju višje kot v javnem sektorju. V magistrski nalogi so tudi razdelane razlike med »ukinitvijo organa« ter med »prenosom nalog«, kjer ne pride do prenehanj pogodb o zaposlitvi. Proučevano je, ali je institut prenosa nalog podoben institutu spremembe delodajalca po Zakonu o delovnih razmerjih (ZDR-1) in v zvezi s tem tudi sodna praksa Sodišča EU in sodišč v Sloveniji. Do neke mere drugačna ureditev se zaradi narave in področja dela javnih uslužbencev ohranja tudi v madžarskem sistemu, s katerim se primerja ureditev prenehanja pogodbe o zaposlitvi zaradi ukinitve državnega organa.

Title:The abolition of state authority as a reason for termination of employment contratcts
Abstract:In my Master’s thesis I discuss the employment contract termination of state public servants due to business reasons with emphasis on termination of the contract due to dissolution of a state authority under the the second paragraph of Article 153 of the Civil Servants Act (ZJU). Because of the specific provisions of the Civil Servants Act (ZJU), under which the public servant's employment contract may be terminated due to the dissolution of a state authority and which apply for employment contract termination due to business reasons, I also discuss the cancellation of a public servant's contract for the above-mentioned reason as one of the reasons for employment contract cancellation. The cancellation due to public-finance reasons, which the above-mentioned act classifies among business reasons for cancellation, is also discussed in detail. Despite the fact that in terms of termination of employment contracts the position of public servants is increasingly becoming similar to the position of private sector employees following the amendment of the Civil Servants Act (ZJU) from 2005, there is still a belief that the level of safety of public sector employees is higher than the level of safety of employees in the private sector. Moreover, from the information obtained in the Master's thesis it arises that the number of terminations due to business reasons carried out by employers in the private sector are higher than those in the public sector. The Master’s thesis also differentiates between “dissolution of an authority” and “transfer of functions” where no employment contract termination occurs. The thesis examines whether the institute of the transfer of function can be compared to the institute of the change of employer under the Employment Relationships Act (ZDR-1) and in this respect also examines the case law of the EU Court and the courts in Slovenia. A somewhat different arrangement due to the nature and scope of work of public servants is also preserved in the Hungarian system, which was used for comparison of the arrangement of employment contract termination due to the dissolution of state authority.
