Title:ORGANIZACIJSKI VIDIK CENTRALIZACIJE JAVNEGA NAROČANJA

Abstract:Centralizacija javnega naročanja postaja trend po svetu in v Evropi v zadnjih letih, ki je narastel tudi zaradi gospodarske in finančne krize. Oblasti centralizacijo prepoznavajo kot sredstvo za zniževanje javne porabe in hkrati kot sredstvo za večjo učinkovitost in uspešnost javnega naročanja. Naloga obravnava institut centralizacije javnega naročanja z organizacijskega vidika, pri čemer proučuje njen koncept s teoretičnega vidika in analizira njene prednosti in slabosti. Predstavljena so izhodišča v zadnjih evropskih direktivah 2014/24/EU in 2014/25/EU, ki podrobneje urejata posamezna vprašanja v zvezi z že uveljavljenimi tehnikami centraliziranega naročanja v praksi držav članic preko centralnih nabavnih organov, priložnostnega skupnega javnega naročanja in čezmejnega skupnega javnega naročanja. Direktivi ne določata organizacijskih oblik centralizacije, temveč so te prepuščene nacionalnim ureditvam in praksi držav članic. Potekajo preko različnih oblik sodelovanja med naročniki (javno-javnih partnerstev), ki jih lahko razdelimo glede na podlage za nastanek sodelovanja (pogodbene in statusne) ter glede na tipe vključenih naročnikov (horizontalno, vertikalno in kombinirano sodelovanje). Optimalni model centralizacije ne obstaja, ampak lahko govorimo le o iskanju njegove najprimernejše oblike. Naloga analizira obstoječe stanje organizacije centralizacije javnega naročanja v Republiki Sloveniji s podanimi predlogi izboljšav ter predstavlja primerjalno ureditev centralizacije v Veliki Britaniji in Avstriji.

Title:The organisational point of view of centralization of public procurement
Abstract:Centralization of public procurement is becoming a trend all around the world and in Europe in recent years, which has also increased because of the economic and financial crisis. The authorities´ centralization identified as a means to reduce public spending and at the same time as a means to increase the effectiveness and efficiency of public procurement. Thesis is addressing the institute of centralization of public procurement of the organizational point of view, while investigating its concept of theoretical point of view and analyse its pros and cons. Presented are the basis in the recent European directives 2014/24/EU and 2014/25/EU that regulate in detail some issues relating to the centralised procurement techniques that the Member States have established already in practice through central purchasing bodies, occasional joint procurement and cross-border joint procurement. The directives does not lay down the organisational forms of centralization, so the national laws and practice of the Member States regulate them. They take place through various forms of cooperation between contracting authorities´ (public-public partnerships), which can be divided according to the basis for the formation of cooperation (contractual and statutory), and depending on types of public authorities´ involved (horizontal, vertical and combined cooperation). The optimal model for centralization does not exist, but we can talk only about finding its best form. Thesis analyse the existing condition of centralization of procurement in the Republic of Slovenia with the given suggestions of improvements and presents a comparative regulation of centralization in Great Britain and Austria.
