Title:Kazniva dejanja zoper delovno razmerje in kazenska odgovornost delodajalca

Abstract:Pravice delavcev iz delovnega razmerja so pomembna civilizacijska pridobitev, katere je potrebno predvsem v času gospodarske krize, posebej varovati. V zadnjem času smo namreč priča številnim kršitvam temeljnih pravic delavcev s strani delodajalcev, ki imajo znake prekrška, pogosto pa tudi kaznivega dejanja. Zaradi takšnih ravnanj delodajalcev so najbolj prizadeti prav delavci, posredno pa tudi država, ki ne dobi plačanih prispevkov iz socialnih zavarovanj delavcev, s čimer so ogroženi temelji socialne varnosti v državi. Magistrska naloga obravnava normativne značilnosti kaznivih dejanj zoper delovno razmerje, ki so določena v 22. poglavju Kazenskega zakonika (KZ-1), s poudarkom na njihovi blanketni naravi, ki v praksi zaradi obsežnosti predpisov s področja delovne, davčne in socialne zakonodaje, povzroča težave tako organom pregona pri odkrivanju in preganjanju kaznivih dejanj, kot tudi sodiščem pri sojenju ter odločanju o krivdi oziroma kazenski odgovornosti storilca. S tega vidika so v nalogi, v okviru zakonskih znakov in posameznih pojmov v kaznivih dejanjih, prikazane tudi dopolnilne norme iz posameznih področnih zakonov, kjer so temeljne pravice delavcev natančno določene. Ker to področje pokriva tako kazenskopravno kot tudi prekrškovno varstvo, je pri sojenju v posamezni zadevi, potrebno ustrezen poudarek dati tudi ločevanju kaznivega dejanja od prekrška in s tem povezanim načelom „ne bis in idem“.

Title:Criminal offences against the employment relationship and criminal liability of the employer
Abstract:Workers’ rights are an important achievement of civilization, and a major effort should be made to protect them. This is an especially sensitive issue in the times of economic crisis. Fundamental workers’ rights have often been breached by employers, resulting in minor as well as criminal offences. Such violations primarily affect the workers themselves; however, even the foundations of social security are breached if social insurance contributions are not paid for. The master thesis deals with normative characteristics of criminal offences against the employment relationship as codified in Chapter 22 of the Criminal Code (KZ-1). Those criminal offences are often established by means of blanket norms and as such, considering the extensive amount of provisions of other branches of law, e.g. work-, tax- and social security law, present problems for law enforcement authorities and courts of justice. The thesis pays special attention to complementary norms, defined in other branches of law, precisely codifying fundamental workers’ rights. Breaching fundamental workers’ rights can represent a crime or a minor offence, which requires the use of principle “ne bis in idem” in addressing the above mentioned violations.
