Abstract:Mediacija je med alternativnimi oblikami reševanja sporov najbolj uspešna, saj je njeno bistvo rešiti sporna vprašanja, tako da bosta obe stranki zadovoljni. Diplomsko delo predstavi družinsko mediacijo kot metodo alternativne oblike reševanja sporov, pravno podlago za izvajanje družinske mediacije v Sloveniji, temeljne značilnosti in načela mediacijskega postopka. Posebej je izpostavljen otrok v mediaciji, saj je povezan preko načela varovanja otrokove največje koristi z mediatorjem in je pomemben člen mediacije, saj se starša opominja naj mislita na otrokove koristi in dosežeta sporazum glede spornih zadev. Bistvo mediacije je, da sta starša še naprej partnerja v odločitvah, ki vključujejo otroke v tednih, mesecih in letih, ki bodo sledila ločitvi. Kot osrednja tema je izpostavljen mediator in njegova vloga v družinski mediaciji. Kljub njegovi nepristranskosti in nevtralnosti in brez možnosti končnega odločanja, spoznamo njegovo delo, načela mediacije, ki jih mora upoštevati in etična načela. Predstavljeno je delo mediatorja v družinski mediaciji v Britanski Kolumbiji, njegova zakonodajna ureditev in načela, ki jih mora spoštovati.

Title:MEDIATOR IN FAMILY MEDIATION - COMPARISON BETWEEN SLOVENIA AND BRITISH COLUMBIA
Abstract:Among alternative dispute resolutions, mediation is the most successful, because it is based to resolve disputed issues so that both parties are satisfied. The thesis presents family mediation as a method of alternative dispute resolution, legal basis for the implementation of family mediation in Slovenia, basic principles and features of mediation. Children are exposed in mediation, because they are connected, via the principle of protecting the child's best interests, with the mediator and they are an important part of the mediation, because the mediator reminds parents to think of the interests of the child and come to an agreement about disputed issues. The premise of mediation is that parents continue to be partners in decision-making involving their children in the weeks, months and years following divorce. The main theme is the mediator and its role in family mediation. Despite his impartiality and neutrality and without the possibility of a final decision, his work is introduced, the principles of mediation, which he must take into account and ethical principles. It includes the work of a mediator in family mediation in British Columbia, and its legislative system and the principles which must be respected.
