Spremembe so podrobneje predstavljene v nadaljevanju magistrskega dela.
Keywords:nacionalni postopek v sporu majhne vrednosti, evropski postopek v sporu majhne vrednosti, načelo ekonomičnosti in pospešitve postopka, načelo pisnosti, načelo materialne resnice, načelo obojestranskega zaslišanja, načelo sorazmernosti, načelo pomoči prava nevešči stranki, primerjalno pravo.

Title:PRINCIPLES OF THE SMALL CLAIMS PROCEDURE BY CPA AND COMPARISON WITH EUROPIAN SMALL CLAIMS PROCEDURE
Abstract:The master’s thesis is focused on the principles of the small claims procedure, which is at the level of our national law, regulated by Civil Procedure Act (hereinafter CPA) as well as at the European level regulated by Regulation no. 861/2007. Towards the end of the thesis follows the comparison of the two procedures. This procedure is special because of the low value of the claim, amounting 2.000 euros and this is exactly why the principles in this specific procedure differ from the principles of ordinary procedure. Regardless to adjusting the principles and simplicity of the procedure in small claims, it is not reduced the quality of legal protection. In addition to the internal litigations, there are also many cross-border litigations, because more and more people use online purchases what increases the number of cross-border litigations. In order to enhance access to justice, was the European Union adopted Regulation no. 861/2007 establishing a european small claims procedure, which simplifies and speeds up the cross-border small claims procedures. Over time, however, it became clear that the regulation was not sufficient, which is also shown below the thesis. For this reason, the Commission adopted a Proposal amending Regulation no. 861/2007, in which there were some proposals, that have not been fulfilled and proposals that have been supported by the European Parliament and Council. The latter adopted Regulation no. 2015/2421 that amending Regulation no. 861/2007, which should, with many corrections, among them the most important about the value of the claim, increases the number of claims in the european small claims procedure and allows more efficient process. The changes are presented in more detail in the following of thesis.
Keywords:national small claims procedure, european small claims procedure, the principle of procedural economy and expedition of proceedings, the written form principle, the substantive truth principle, hearing both partiesprinciple, the principle of proportionality, the legal assistance principle, comparative law.
