Title:Pravna ureditev trženja vzajemnih skladov Infond d.o.o. v odvisnosti od njihove usmerjenosti, tveganosti

Abstract:V diplomskem delu je predstavljen pravni vidik delovanja vzajemnih skladov v Republiki Sloveniji. Od leta 2002-2015, je v skladu s smernicami in direktivami Evropske unije, Slovenija sprejela tri novele Zakona o investicijskih skladih in družbah za upravljanje (ZISDU-1, ZISDU-2 in ZISDU-3). Sprejemanje zakonodaje in njena nadgradnja z novejšimi zakoni, predstavlja pomemben prispevek k delovanju slovenskih vzajemnih skladov. Predvsem po vstopu Slovenije v EU se je ta zavezala, da bo svoj pravni red poenotila s pravnim redom EU. Izziv sprejemanja novejše zakonodaje na področju trgovanja z vrednostnimi papirji, je bil predvsem lažje širjenje slovenskih investicijskih skladov v druge države EU in lažja registracija tujih investicijskih družb v Sloveniji. V diplomskem delu so tako prikazane prednosti sprejetja modernejše zakonodaje na področju investicijskih skladov, še posebej v smeri zaščite vlagateljev in družb v mednarodnem okolju. Dokazujemo, da slovenska pravna ureditev ne zavira trgovanja s tujimi investicijskimi skladi. Novosti v slovenski pravni ureditvi, pri trgovanju z vzajemnimi skladi, pospešujejo denarna vlaganja v vrednostne papirje. Zaradi sprejete zakonodaje na področju vrednostnih papirjev, je za slovenske vlagatelje portfelj varnejši in dostopnejši. Raziskave temeljijo na slovenski zakonodaji s področja vzajemnih skladov in na analizi družbe Infond d.o.o.

Title:Marketing regulation of the Infond d.o.o. mutual funds in relation to their orientation and risk
Abstract:Bachelor's thesis presents the legal aspect of the activities of mutual funds in the Republic of Slovenia. Between the years 2002 and 2015, Slovenia accpeted and complied with the EU guidelines and directives by adopting three Amendment Acts of the Law of Investment Funds and Management Companies (ZISDU-1, ZISDU-2 and ZISDU-3). The adopted legislation with its upgrades represents the major contribution to the operation of the Slovenian mutual funds. After joining the EU, Slovenia committed to synchronise its legal framework with the acquis of the EU. The main challenge of the adoption of the upgraded securities legislation is in the facilitation of the expansion of Slovenian investment funds to other EU Member States and the facilitated registration of foreign investment firms in Slovenia. Bachelor's thesis illustrates the advantages of adopting modern investment fund legislation, especially in terms of protecting investors and investment firms in the international environment. The thesis demonstrates that Slovenian regulations do not inhibit trading with foreign investment funds. New features of Slovenian trading in securities regulation promote monetary investments into securities. The adopted securities legislation has made securities portfolios safer and more accessible to Slovenian investors. The research carried out as part of the thesis is based on Slovenian mutual fund legislation and analyses of Infond d.o.o.
