Title:POGOJI IN MERILA PRI DOKAZOVANJU FINANČNE SPOSOBNOSTI PONUDNIKA

Abstract:Javno naročanje posrednih in neposrednih proračunskih porabnikov ima pomemben vpliv na porabo državnega proračuna, zato so ti porabniki zavezani sklepati pogodbena razmerja samo s podjetji, ki v celoti izpolnjujejo svoje obveznosti tako do države, kot do drugih gospodarskih subjektov in s tistimi, ki so sposobni sprotno poravnavati vse svoje obveznosti. Naročnik mora upoštevati temeljna načela javnega naročanja, postaviti pravilne pogoje in merila in posledično izbrati najugodnejšega ponudnika, ki bo za naročnika izvedel dobavo blaga, opravil storitev ali gradnjo. Postavljeni pogoji ne smejo biti diskriminatorni, kar pomeni, da naročnik ne sme privilegirati določenega ponudnika. Pri izbiri najugodnejšega ponudnika se naročnik zraven tehnične in kadrovske sposobnosti ter sposobnosti za opravljanje poklica osredotoči tudi na ekonomsko in finančno stanje ponudnika, saj si le tako lahko zagotovi smotrn podpis pogodbe in izvedbo predmeta javnega naročila brez zapletov. Ponudnik, ki nima blokiranih poslovnih računov in je sposoben sproti plačevati svoje obveznosti, je definitivno eden izmed razlogov za sklenitev pogodbe. Da pa se naročnik pred tveganjem v času izvajanja pogodbe še dodatno zavaruje, lahko od ponudnika zahteva različne finančne instrumente zavarovanja. Najpogostejši instrument zavarovanja je bančna garancija, ki se lahko izdaja kot garancija za resnost ponudbe, za dobro izvedbo posla in odpravo napak v garancijskem roku.

Title:STANDARDS AND CONDITIONS DEMOSTRATION OF FINANCIAL ABILITY BY TENDERER
Abstract:Procurement of direct and indirect budget users has a significant impact on the consumption of the state budget, which is why these consumers are committed to conclude contractual relationships only with companies that comply fully with its obligations both to the country as to other economic operators and those who are able to promptly settle all its obligations. The contracting authority must respect the fundamental principles of public procurement, to set the correct conditions and criteria and consequently select the most favorable bidder, which will be delivered to the subscriber supply of goods, services or construction tasks. Conditions imposed must not be discriminatory, which means that the client is not allowed to favor a particular bidder. When choosing the most favorable bidder, the contracting level of technical and human skills and the ability to practice focuses on the economic and financial status of the bidder, since it is the only way you can ensure proper signature of the contract and the execution of the contract being awarded without complications. The landlord, who has not blocked business accounts and is able to regularly pay their obligations is definitely one of the reasons for its conclusion. However, the contracting authority against the risk during the implementation of contracts, additional collateral may ask the tenderer various financial instruments for insurance. The most common instrument insurance is a bank guarantee, which may be issued as tender guarantee, performance bond and elimination of defects during the warranty period.
