Title:PRENEHANJE POGODBE O ZAPOSLITVI

Abstract:V diplomskem delu smo prikazali pravno ureditev pogodbe o zaposlitvi in njeno prenehanje z odpovedjo. Predstavili smo pravice, obveznosti ter odgovornosti na strani delavca in delodajalca v primeru individualne redne in izredne odpovedi pogodbe o zaposlitvi. Podrobno smo zapisali aktivnosti, ki jih mora opraviti delodajalec oziroma delojemalec pred podajo odpovedi pogodbe o zaposlitvi, ter posamezne faze postopka vodenja odpovedi. Vsak posamezen korak lahko vpliva na zakonitost odpovedi pogodbe o zaposlitvi. Izoblikovana sodna praksa nakazuje na dejstvo, da je za pravilno izpeljan postopek odpovedi potrebno upoštevati vse zakonsko določene obveznosti, zapisane v ZDR-1. Pomembni so prav vsi formalni postopki: podaja odpovedi znotraj določenih rokov, oblika in vsebina odpovedi ter vročanje. Redna ali izredna odpoved pogodbe o zaposlitvi brez vsebinsko utemeljenega razloga je v primeru spora neveljavna. Sprememba delovnopravne zakonodaje v letu 2013 je prinesla nekatere poenostavitve v postopku odpovedi pogodbe o zaposlitvi delodajalcem ter zmanjšala administrativne ovire. Na drugi strani naj bi se povečala pravna varnost zaposlenih in zmanjšale zlorabe. Preučili smo poenostavitve in raziskali njihov vpliv na kršitve na tem področju. Inšpekcijski nadzor nad izvajanjem zakona v praksi je pokazal, da so se zmanjšale kršitve na področju vročanja odpovedi in v samih postopkih pred podajo le-te, povečale pa so se kršitve delovnopravne zakonodaje nasploh.

Title:TERMINATION OF EMPLOYMENT CONTRACT
Abstract:In the diploma thesis we have presented the legal norms of employment contract and its termination modes. We have presented the rights, obligations and responsibilities of workers and employers in the case of individual regular and extraordinary termination of employment. We have specified the activities that should be accomplished by the employer or the employee before handing in the termination letter. We have presented certain stages of managing employment termination. Each step can influence the legitimacy of employment termination. According to judicial practice it is important for a correctly handled termination of employment to consider all procedures prescribed in Employment Relationship Act. It is of great importance to follow all required formal procedures and time limits. The form and content of the employment termination letter and delivering it are significant. Regular or extraordinary termination of employment contract without justifiable grounds is invalid in case of litigation. The changes of Employment Relationship Act in 2013 on one hand brought simplifications of procedures and reduced administrative obstacles of employment termination for employers. On the other hand, due to these changes workers' employment is more secure and there should be less misuses. We have studied the simplifications and their influence on violations in this field. Inspection surveillance of law enforcement in practice showed that the number of violations has fallen on the field of delivering letters of terminations of employment and the procedures before the delivery. But the number of violations of Law in Employment Relations in general has increased.
