Title:Garancija za brezhibno delovanje stvari - primerjava pravil OZ in ZVPot

Abstract:Garancija za brezhibno delovanje stvari je institut, ki predstavlja kupcu jamstvo, da bo stvar v garancijskem roku brezhibno delovala. V slovenski zakonodaji jo urejata Obligacijski zakonik in Zakon o varstvu potrošnikov. Glavni namen mojega diplomskega dela je primerjava pravil obeh zakonov na področju navedenega instituta. Iz ureditve OZ izhaja, da ta ureja prostovoljno garancijo, ZVPot pa v večini določb v poglavju o garanciji ureja obvezno garancijo, razen prvih štirih členov, ki veljajo za obe vrsti. Vendar pa pravila OZ dopolnjujejo ZVPot, glede tistih vprašanj, ki v slednjem niso urejena - tudi v primeru obvezne garancije. Če pride v garancijskem roku do okvare stvari, lahko kupec na podlagi obeh zakonov uveljavlja enake zahtevke. To so: zahtevek za popravilo, zahtevek za zamenjavo, odstop od pogodbe, znižanje kupnine. Z vidika kupca je relevantno, da jih uveljavlja v skladu z določeno hierarhijo, ki jo poznata oba zakona. Poleg navedenih zahtevkov pa lahko uveljavlja tudi odškodnino. Med zakonoma obstajajo razlike glede ureditve rokov, ki jih mora kupec poznati za uspešno uveljavljanje pravic iz naslova garancije. ZVPot določa minimalno dolžino garancijskega roka, medtem ko je OZ ne predpisuje. Razlika je tudi v ureditvi roka za odpravo napake, ki se ga mora držati garant, saj ga ZVPot v nasprotju z OZ konkretizira. Tudi dolžina roka za sodno uveljavljanje pravic se razlikuje - ZVPot namreč določa daljšega kot OZ.

Title:GUARANTEE-COMPARISON OF PROVISIONS BETWEEN OZ AND ZVPot
Abstract:Guarantee is an instrument which ensures customers flawless operation of goods within the guarantee period. In Slovenian legislation the instrument is governed by Obligations Code (OZ) and Consumer Protection Act (ZVPot). The main purpose of my thesis is to compare provisions about guarantee between both acts. OZ governs voluntary guarantee, while ZVPot, in most of the provisions, governs obligatory guarantee, except for the first four articles which relate to both, voluntary and obligatory guarantee. However, provisions of the OZ complement ZVPot in the issues that are not governed in the latter – also with regard to obligatory guarantee. In case the product purchased malfunctions, consumers have the right to the same kind of claims based on both laws. These are: demand for repair or replacement, withdrawal from the contract, reduction of purchase money. It is relevant that consumers claim their rights in conformity of the hierarchy of both laws. Beside the listed claims consumers may also claim compensation. There are differences between both laws as to time limits which consumers must regard as to be successful in their claims. ZVPot stipulates the minimal guarantee period, while OZ does not. There is a difference also in the rules governing the time limit for correcting malfunctions that a guarantor is to abide by, since it is concretely stated in ZVPot. Another difference is in the time limit to claim consumer rights in court – in ZVPot it is longer than in OZ.
