Title:Izročitev premične stvari v posest z namenom prenosa lastninske pravice

Abstract:V diplomski nalogi z naslovom Izročitev premične stvari v posest z namenom prenosa lastninske pravice, bom predstavila pomen izročitve, ki jo le-ta predstavlja pri prenosu lastninske pravice na premičninskem področju. Izročitev predstavlja zadnje dejanje, ki je potrebno, da lastninska pravica na stvari preide. Na začetku bom najprej predstavila razlike med lastninsko pravico in posestjo ter ju prikazala kot dva instituta, ki zahtevata strogo ločevanje. Lastninsko pravno razmerje bom opredelila kot temeljno stvarnopravno razmerje in prikazala razlike med prenosom lastninske pravice na premičninskem in nepremičninskem področju. Diplomska naloga nadalje povzema vse predpostavke, ki morajo biti izpolnjene, da lastninska pravica sploh lahko preide. Tako so predstavljeni: zavezovalni pravni posel, razpolagalni pravni posel, razpolagalna sposobnost odsvojitelja ter drugi pogoji, ki jih določa zakon. Dotaknila se bom tudi primera pridobitve lastninske pravice od razpolagalno nesposobne osebe in predstavila pogoje, ki morajo biti izpolnjeni, da lastninska pravica vseeno preide kljub pomanjkanju ene izmed predpostavk. Poudarek diplomske naloge je na izročitvi. Dejanska izročitev predstavlja pravilo, ki pozna tudi nekaj izjem. V nalogi bo izpostavljeno, da dejanska izročitev v nekaterih primerih ne bi bila praktična in bi predstavljala prevelik formalizem, s čimer bi zavirala potrebo po hitrejšem prometu s premičninami, ki ga narekuje današnja družba. Vsako od izjem bom natančno predstavila, nekatere bom podprla tudi s sodno prakso.

Title:DELIVERY OF MOVABLE PROPERTY INTO POSSESSION WITH THE INTENTION TO TRANSFER OWNERSHIP
Abstract:The aim of the dissertation entitled Delivery of movable property into possession with the intention to transfer ownership is to present the importance of delivery within the act of ownership transfer in movable property field. The delivery is the final act enabling the ownership transfer. In the first part, the difference between ownership and property is presented and the latter are shown as the two institutions between which a strict distinction needs to be drawn. I defined property relationship as a basic relationship of property under the law and point out the difference between the ownership transfer in movable and immovable property field. Further, the dissertation sums up all the assumptions that need to be met enabling ownership transfer itself to be realized in the first place. Therefore the following are presented: binding legal transaction, disposing legal transaction, disposing capability of alienator, and other conditions declared under law. Included is also a case of ownership acquisition from an entity incapable of disposal and there are conditions presented that need to be met in case when ownership transfer is still realized in spite of the fact that one of the assumptions is lacking. As evident from the dissertation's title the main theme is delivery. The actual delivery presents a rule, however there are some exceptions to it. As presented further on, the actual delivery in some cases would not be practical and would present to high of formalism which would inhibit the need for faster pace of sale of movability determined by today's society. Each of the exceptions is presented into details, some of which are also supported by court practice.
