Title:PRAVNI VIDIKI NADZORA ECB NAD SLOVENSKIMI SISTEMSKIMI BANKAMI

Abstract:Finančna kriza je odličen primer, s katerega smo se naučili, kako hitro se lahko razširijo negativni vplivi iz ene države v drugo in kakšno razdejanje lahko to pusti za sabo. Z namenom, da se zgodba ne bi več ponovila, se je junija 2012 Evropski svet odločil prekiniti začarani krog med bankami in državami in naznanil prihod bančne unije. Ta je zaživela 4. novembra 2014 z vzpostavitvijo prvega stebra bančne unije, ki je enotni mehanizem nadzora. V prvem poglavju diplomskega seminarja je predstavljen opis področja ter namen, cilji in hipoteze raziskave. V nadaljevanju sem raziskala, kako je sestavljena bančna unija, kakšni so njeni cilji, kaj zajema delovanje posameznega stebra bančne unije in na kašnem temelju sta bila utemeljena. V tretjem poglavju sem se podrobneje posvetila enotnemu mehanizmu nadzora kot prvemu stebru bančne unije. Raziskala sem, kako se delijo nadzorniške naloge, kakšna je organizacijska struktura in vloga Evropske centralne banke ter kako je potekala izvedba celovite ocene. V četrtem poglavju sem predstavila, kakšni so bili odzivi, kritike in predlogi strokovnjakov ob vzpostavitvi bančne unije. V zadnjem poglavju pa sem raziskala, kako je z dogajanjem na slovenskih tleh. Posvetila sem se slovenskim sistemskim bankam, predvsem Novi Kreditni banki Maribor in Novi ljubljanski banki, ki sta tudi sodelovali v stresnih testih.

Title:LEGAL ASPECT OF THE EUROPEAN CENTRAL BANK (ECB) CONTROL OVER THE SYSTEMIE BANKS OF SLOVENIA
Abstract:The financial crisis is a perfect example from which we can learn how fast the negative effects can spread from one country to another and what havoc can be left afterwards. To make sure that the story would not be repeated again, in June 2012 the European Council decided to break the vicious circle between banks and countries and announced the arrival of a banking union. This goes live on 4th of November 2014, with the establishment of the first pillar of the banking union, which has a Single Supervisory Mechanism. The first chapter presents a description of scope, purpose, objectives and research hypotheses of the thesis. In the continuation I researched the structure of banking union and its goals. Furthermore, the functioning of each banking union pillar and the foundation which they were based on is explained. In the third chapter, I gave special attention to the Single Supervisory Mechanism of control as the first pillar of the banking union. I researched how the supervisory duties were shared, what the organizational structure and role of the European Central Bank is, and how the execution of a comprehensive evaluation took place. In the fourth chapter I presented what were the reactions, criticisms and suggestions of experts on the establishment of a banking union. Finally, in the last chapter, I explored the developments in the Slovenian territory. I focused my attention to the Slovenian systemic banks, particularly Nova Kreditna banka Maribor and Nova ljubljanska banka, which also participated in the stress tests.
