Title:IZBRISNA TOŽBA - MATERIALNOPRAVNI IN PROCESNOPRAVNI VIDIK S PREGLEDOM AKTUALNE SODNE PRAKSE

Abstract:To diplomsko delo je rezultat preučevanja zakonov ter ostalih pravnih aktov, vključno z njihovimi komentarji, raznih publikacij, sodne prakse ter ostalih bibliografskih virov. V njem je kompleksno in podrobno predstavljen institut izbrisne tožbe ter njegov materialnopravni in procesnopravni vidik. Prav tako so opredeljene tudi z njim vsebinsko povezane teme, kot so zgodovinski pregled zemljiškoknjižnega prava, pojem zemljiškoknjižnega prava, zemljiškoknjižna načela, popolna informatizacija v zemljiškoknjižnem postopku, nepremičninske evidence, zemljiška knjiga, zemljiškoknjižni postopek, posebni zemljiškoknjižni postopki, nepravilni vpisi v zemljiško knjigo, varstvo vrstnega reda, večkratna odsvojitev iste nepremičnine, spremembe instituta izbrisne tožbe od leta 1995 ter aktualna sodna praksa na področju izbrisne tožbe. Zemljiška knjiga je namenjena vpisu stvarnih in z Zakonom o zemljiški knjigi določenih obligacijskih pravic. Če je vknjižba stvarne ali določene obligacijske pravice iz kakršnegakoli razloga materialnopravno neveljavna, pridobi prejšnji imetnik pravice - odsvojitelj proti novemu imetniku pravice - pridobitelju pravno varstvo že z odpravo pravnega temelja, ki predstavlja pravno podlago za vknjižbo pravice v zemljiško knjigo. Odprava le-tega pa zaradi načela kavzalnosti vedno vodi do razveljavitve zemljiškoknjižnega dovolila, saj odprava zavezovalnega pravnega posla povzroči prenehanje učinkov razpolagalnega pravnega posla . Ustvari se položaj, kakor da pravica na pridobitelja nikoli nebi prešla. Odsvojitelj pa mora kljub temu poskrbeti še za izbris materialnopravno neveljavne vknjižbe iz zemljiške knjige in sicer zaradi dosega polnega učinkovanja svoje pravice tudi v razmerju do tretjih oseb, katere varuje načelo zaupanja v zemljiško knjigo, temu pa je namenjena izbrisna tožba. Gre za nekakšen zrcalni postopek vknjižbe. Pri ustvarjanju diplomskega dela je bila uporabljena opisna (deskriptivna) metoda s preučitvijo različnih literatur, komparativna metoda na področju primerjav, zgodovinska metoda pri poglavju o spremembah instituta izbrisne tožbe od leta 1995, metoda klasifikacije ter metoda analize in sinteze.

Title:THE ACTION FOR CANCELLATION - SUBSTANTIVE AND PROCEDURAL LAW ASPECT WITH THE CURRENT CASE LAW REVIEW
Abstract:This diploma paper is the result of studying the laws and other legal acts, including their comments, various publications, case-law and other bibliographic resources. It presents the cancellation action institute and its substantive and procedural aspects in a complex and detailed way. In the diploma paper are also defined with it substantively related topics, such as historic overview of the land registry law, the concept of land registry law, land registry principles, complete computerization in the land registry proceeding, real estate records, Land Register, land registry procedure, special land registry procedures, incorrect registration fees, order protection, multiple alienation of the same property, changes in the institute of cancellation action since 1995 and the current case-law in the field of cancellation action. Land Register is intended to enroll the rights in rem and the obligation rights defined by the Land Register Act. If the entry in rem or obligation rights is for any reason substantive invalid, obtains the right the previous holder - the vendor- against the new holder of the right – acquirer- legal protection already with the elimination of legal basis, which constitutes the legal basis for entry in the Land Register. Abolition of it due to the principle of causality always leads to the annulment of the land registry permit, since the abolition of binding transaction results in termination of effects of disposed transaction. Such a situation is created as that the right would never move to the acquirer. The vendor must nevertheless provide for the deletion of substantive invalid entry from the Land Register due to reach full effect of his rights in relation to third parties, which protects the principle of trust in the Land Register, this is intended for cancellation action. It is a kind of mirror entry process. When creating this diploma thesis it was used descriptive method by examining the various literatures, comparative method in the field of comparisons, historical method in the chapter on amendments of the institute of cancellation action since 1995, classification method and the method of analysis and synthesis.
