Abstract:Postopek predaje tujca, ki zaprosi za mednarodno zaščito, varni tretji državi, se v Republiki Sloveniji trenutno ne izvaja od leta 2013, čeprav ga v področni slovenski zakonodaji še vedno najdemo. A, ker je težko podati strokovno kritiko na postopek, ki se praktično ne izvaja, smo zaradi podobnosti s postopkom predaje prosilca varni tretji državi, vzporedno analizirali še t. i. dublinski postopek. Gre za dva postopka, ki imata temelje v evropski sekundarni zakonodaji, s katerima se vzpostavlja sistem odgovornosti za obravnavo prosilca za mednarodno zaščito na državnih nivojih. Skupna evropska zakonodaja sicer stremi k poenotenju teh postopkov med državami članicami Evropske unije in skuša vzpostaviti enotni azilni sistem, vendar ji pri praktični izvedbi teh postopkov ne uspeva. Ta neuspeh se odraža v neharmonizirani izvedbi teh postopkov med državami članicami in zagotavljanju neenakega varstva pravic prosilcev. Neharmoniziranost postopkov in posledično zagotavljanje različnih pravic prosilcev smo prikazali in dokazali s citati relevantnih pisnih virov in poznavanjem lastne problematike. Dejanske odklone med državami članicami v zagotavljanju pravic prosilcev pa smo dokazali z intervjujem, ki smo ga opravili z anonimnim prosilcem za mednarodno zaščito, v procesu dublinskega postopka. V nalogi smo povzeto iz vseh ugotovitev prišli do zaključka, da se je varstvo pravic prosilcev za mednarodno zaščito v tretjih varnih državah bistveno izboljšalo po zagotavljanju standardov, ki se po evropski zakonodaji zahtevajo za varno tretjo državo. Med tem ko ostaja v državah članicah, ki same po sebi veljajo za prosilce mednarodne zaščite varne države, različen nivo zagotavljanja varstva pravic prosilcev.

Title:THE PROCEDURE FOR SURRENDERING AN ALIEN WHO APPLIES FOR INTERNATIONAL PROTECTION TO A SAFE THIRD COUNTRY
Abstract:Since 2013 the Republic of Slovenia is temporarly not implementing the procedure of readmission for international protection seekers to third country, even though the procedure can still be found in sectoral Slovenian legislation. Because it is difficult to give a professional critique on the practically not implemented procedure, we parallel analyse so called Dublin procedure, which is similar to procedure of readmission for international protection seekers. These are two procedures that foundations lay in the European secondary legislation, which establishes a liability regime for dealing with asylum international protection at the state level. Common European legislation namely strives to standardize these procedures between Member States of the EU in trying to establish a common asylum system, but the practical implementation of these processes is unsuccessful. This failure is reflected in the non-harmonized implementation of these procedures between Member States by providing unequal protection of the rights of applicants. Non-harmonized procedures have consequence to provide different rights of asylum, which we show and demonstrated by relevant written sources and own knowledge on that problems. Actual deviations between Member States in ensuring the rights of asylum, we have showen with an interview, with the anonymous applicant for international protection, which is currently under the Dublin procedure. From all the considerations that was taken in the study, we make the conclusion that the protection of applicants rights for international protection in a safe third countries significantly improved after ensuring European legislation requiring standards for a safe third country. While still in Member States which themselves apply for asylum international protection of safe countries, providing a different level of protection of the rights of applicants.
