|Abstract:||The thesis deals with the investigation procedure of a place, where the offence of environmental crime was committed. In most cases the main reason for the offence of environmental crime is profit, as the environmentally friendly management of hazardous wastes can be very expensive. Sometimes pollution with hazardous and toxic substances can occur by accident or negligence, so all the pollution of the environment cannot be defined as a criminal offence. Since each of us can be an offender of environmental crime, this kind of crime is very difficult to investigate. We wanted to take detailed note with the investigation procedure of a place, where the offence of environmental crime was committed, in the Republic of Slovenia and the Republic of Serbia, and conduct a comparison between the two procedures, which we made by using different research methods.
We ascertained that in both countries the investigation procedure of a crime scene is well organized and that the investigation procedures in the Republic of Slovenia and the Republic of Serbia, as it was expected on the base of our shared history, differ only in a few small details. Namely, the Republic of Serbia has defined and recorded specificities about inspecting the crime scene of each environmental crime, and it has no investigating judge function. Besides that the procedures differ in competence and professionalism of investigators, equipment and technology, frequency and number of conducted investigations or inspected places of crime and the structure of criminal offences.
In order to limit the ecological crime, it is necessary to strengthen ecological awareness among the citizens, thus it needs to start with children; we need stricter punishments for the environmental crime offenders, well equip ecological crime investigators (provide professional training in the field of protection and environmental protection, as well as more money, that they need to carry out the necessary research), and more attention and money for discovering environmentally friendly substances and materials (renewable sources of energy, etc.). We will have to find a middle way between progress and effective protection of the environment if we want to preserve nature for our descendants.|
