Title:Omejevanje pojava rotirajočih vrat

Abstract:Namen prispevka: V prispevku je predstavljen mehanizem nasprotja interesov, imenovan pojav rotirajočih vrat. Namen prispevka je podrobno definirati problematiko in povečati prepoznavnost pojava ter tako omogočiti splošni in strokovni javnosti, da se s problematiko pojava dobro seznani in pojav prepozna tudi v praksi. Prispevek hkrati predstavi reguliranje pojava rotirajočih vrat v Sloveniji in Belgiji. Metode: Osnova tega prispevka je analiza literature domačih in tujih avtorjev ter mednarodnih organizacij, ki se ukvarjajo s problematiko pojava rotirajočih vrat ter nacionalne zakonodaje s tega področja. Obstoječa spoznanja bodo z metodo klasifikacije, metodo deskripcije in metodo kompilacije prenesena na slovenski prostor. Ugotovitve: Sodelovanje in izmenjava položajev med javnim in zasebnim sektorjem ima lahko pozitivne učinke v smislu izboljšanja delovanja na različnih področjih v obeh sektorjih, a hkrati obstaja nevarnost različnih zlorab s strani posameznikov in organizacij, ki osebno korist postavijo pred javni interes. Ko govorimo o pojavu rotirajočih vrat, hitro trčimo ob dva nasprotujoča si interesa, in sicer osebni interes posameznika in/ali organizacije in splošni interes javnosti. Pojav rotirajočih vrat tako povečuje zaskrbljenost o poštenosti in integriteti javnih uslužbencev, predvsem zaradi nasprotja interesov, ki povzroča pristranskost pri javnem odločanju. Na ta način se znatno zmanjšuje zaupanje javnosti v državo in v delovanje njenih institucij. Razvoj in izvajanje učinkovitih ukrepov za preprečevanje negativnih oblik pojava rotirajočih vrat lahko pomaga ponovno vzpostaviti in ohraniti to zaupanje. Izvirnost/pomembnost prispevka: V slovenskem prostoru ni analiz pojava rotirajočih vrat, kar še posebej velja za objave v strokovnih publikacijah. S tem prispevkom skušamo zapolniti to vrzel in opozoriti na problematiko pojava rotirajočih vrat ter obenem pozvati k učinkoviti regulaciji.

Title:Curbing Revolving Door
Abstract:Purpose: This paper presents a form for conflict of interest, the so-called revolving door phenomenon. The purpose of this paper is to increase this phenomenon’s (problems) visibility and to define it in detail.Thus allowing for the general and professional public to acquaint with this issue and to recognize it in practice.Paper also presents how occurrences of this phenomenon are being managed in Slovenia and Belgium and also shows future possibilities for regulating this harmful social phenomenon. Design/Methods/Approach: Paper is bases on the analysis of literature, written by domestic and foreign scholars and international organizations that deal with issues of revolving door phenomenon. National legislation in this field was also reviewed. Existing knowledge will be trough the methods of classification, compilation and description applied to at the Slovenian space. Findings: Cooperation and exchange of positions between the public and private sectors can have positive effects in terms of improvement in various areas of both sectors, but at the same time there is a danger of abuse by the various individuals and organizations that put personal gain before the public interest. When speaking about the revolving door phenomenon, we encounter two conflicting interests that is a personal interest of the individual and / or organization and general public interest. Revolving door phenomenon increases concerns about the fairness and integrity of civil servants, mainly due to a conflict of interest that lead to a bias in decision-making of public sectors power holders. In this way, public confidence in the State and in its institutionsis significantly reduced. Development and implementation of effective measures to prevent the occurrence of negative forms of revolving door can help to preserve and restore this trust. Originality/Value: In the Slovenian space there aren’t any analyses of revolving door phenomenon, which is particularly true for publication in professional journals. In this paper we try to fill this gap and to draw attention to issues regarding revolving door phenomenon, and at the same time call for effective regulation.
