Title:PRIKAZ NAJNOVEJŠE SODNE PRAKSE V ZEMLJIŠKOKNJIŽNIH ZADEVAH

Abstract:Vse pravice in pravna dejstva glede nepremičnin vpisujemo v zemljiško knjigo. Imetniki vpisanih pravic lahko zahtevajo spoštovanje njihovih pravic, saj je zemljiška knjiga javna knjiga, namenjena seznanitvi širše javnosti s podatki glede nepremičnin. Vpisi v zemljiško knjigo se urejajo v zemljiškoknjižnem postopku, ki je urejen v Zakonu o zemljiški knjigi (krajše ZZK-1). Leta 2011 je novela ZZK-1C poskrbela za bistvene spremembe v zemljiškoknjižnem sistemu. Zemljiškoknjižno pravo je bilo spremenjeno na področju postopkovnega in materialnega prava. Novela je vpeljala elektronsko vodenje glavne knjige in zbirke listin, posledica česar je novost obveznega elektronskega vlaganja pisanj. To nalogo sedaj opravljajo le kvalificirani vlagatelji, ki izpolnjujejo vse pogoje za vložitev elektronskega zemljiškoknjižnega predloga. S 1. 5. 2011 je v veljavo stopila tudi sprememba pristojnosti glede pritožbenih zadev na drugi stopnji. Izključna pristojnost za pritožbene zadeve zoper odločitve zemljiškoknjižnih sodišč je bila dodeljena Višjemu sodišču v Kopru. Namen generalne delegacije je zasledovati cilj enotne sodne prakse, ki bo pripomogla k hitrejšemu odločanju in zmanjševanju sodnih zaostankov.

Title:A REVIEW OF RECENT CASE LAW REGARDING LAND REGISTRY MATTERS
Abstract:All rights and legal facts relating to the real estate are registered in the land register. Holders of registered rights can demand the observance of their rights, as the land register is a public book, which is meant to provide the general public with the information about real estate. Land registration is governed by the land registry procedure, which is regulated by the Land Register Act (abbreviated as ZZK-1). In 2011, the amendment ZZK-1C provided substantial changes in the land registry system. Land registry law was modified in the field of procedural and substantive law. The amendment introduced electronic management of the general ledger and the collection of documents, resulting in a new mandatory electronic filling of documents. Currently, only qualified applicants, who meet all the requirements for filing electronic land registry proposals, are performing this task. In addition, a change in jurisdiction regarding the appeals of second instance rulings came into force on 1st of May 2011. Exclusive jurisdiction for appeals against the rulings of land registry courts was assigned to the High Court of Koper. The purpose of the general delegation is to pursue the objective of a uniform case law, which will speed up the decision-making process and reduce the backlog of cases.
