Title:PRIPOSESTVOVANJE KOT PRAVNI TEMELJ PRIDOBITVE STVARNIH PRAVIC-PRIPOSESTVOVANJE LASTNINSKE PRAVICE IN SLUŽNOSTI S PREGLEDOM SODNE PRAKSE

Abstract:Diplomska naloga obsega obravnavo instituta priposestvovanja stvarnih pravic in pregled aktualne sodne prakse. Priposestvovanje je izviren način pridobitve lastninske pravice in temelji na treh bistvenih elementih: dobri veri priposestvovalca, izvrševanju posesti oziroma lastniških upravičenj in preteku časa. Eno najpomembnejših vprašanj v zvezi s priposestvovanjem je prav gotovo dopustitev priposestvovanja nepremičnin tistemu, ki se ni vpisal v zemljiško knjigo oziroma tako imenovano izvenknjižno priposestvovanje. V povezavi s tem institutom ima zelo pomembno vlogo zemljiška knjiga, na podlagi katere je zagotovljena publiciteta stvarnih pravic na nepremičnini. V skladu z vpisnim načelom je na pravnoposlovni podlagi mogoče pridobiti lastninsko ali katero drugo stvarno pravico na nepremičninah le z vpisom v zemljiško knjigo. Naša sodna praksa je dolgo dopuščala izvenknjižno priposestvovanje in se pri presoji dobre vere ni opirala na stanje vpisov v zemljiški knjigi, ampak zgolj na dejanske okoliščine. V zadnjih letih pa zemljiška knjiga vendarle dobiva osrednji pomen, tako v zavesti Slovencev, kot tudi v sodni praksi, tako da sodišča dopuščajo izvenknjižno priposestvovanje le v izjemnih okoliščinah. V svojem diplomskem delu sem se v poglavju priposestvovanja lastninske pravice osredotočila predvsem na problematiko izvenknjižnega priposestvovanja in povzela aktualno sodno prakso. V poglavju priposestvovanja služnosti pa so poleg pogojev, obravnavani tudi sodna praksa in posebnosti glede nepravih služnosti in služnosti v javno korist.

Title:PRAESCRIPTION AS A LEGAL BASIS FOR THE ACQUISITION OF RIGHTS IN REM-PRAESCRIPTION PROPERLY RIGHTS AND AESEMENTS WITH OVERVIEW OF LEGAL PRACTICE
Abstract:The thesis examines the institute of acquisition by prescription of property rights and an overview of current case law. Prescription is an original manner of acquiring property rights and based on three key elements: good faith of the acquirer, enforcement of possession or ownership rights and time. One of the most important issues relating to the prescription is allowing real-estate acquisition by prescription to those who are not inscribed in the Land Register, the so-called out-of-Register prescription. Land Register has a very important role in relation to this Institute as it guarantees the publicity of rights in rem in immovable property. In accordance with the inscription on legal and business basis, it is possible to obtain ownership or any other right in rem in immovable property only by an inscription in the Land Register. Our jurisprudence has long tolerated out-of-Register prescription and the assessment of good faith does not rely on the state of the inscriptions in the Land Register, but only to the actual circumstances. In recent years, however, Land Register is being more and more recognised as a central document, both in the minds of Slovenes, as well as the case law so that courts recognise and except out-of-Register prescription only in exceptional circumstances. The chapter of the thesis on the acquisition by prescription of the ownership rights is primarily focused on the issue of out-of-Register acquisition by prescription and summarizes the current case law. The chapter easement by prescription discusses the conditions of the jurisprudence and specifics regarding quasi-easements and easements in the public interest.
