Abstract:Diplomska naloga obravnava sodobne tehnologije, kot je internet, preko katerega dandanes potrošniki množično sklepajo pravne posle s tujimi trgovci in kako ta pravna razmerja vplivajo na razlago pravil o mednarodni pristojnosti. V ospredju analize je Uredba 44/2001 o pristojnosti ter priznanju in izvršitvi sodnih odločb v civilnih in gospodarskih zadevah, pogoji njene uporabe in posebne določbe o pristojnosti v zadevah v zvezi s pogodbami, ki jih sklene potrošnik kot šibkejša stranka pogodbe V ta namen so predstavljeni in analizirani pogoji za uporabo posebnih pristojnosti v potrošniških sporih skozi prakso Sodišča Evropske unije, s poudarkom na posebnostih sklepanja poslov preko interneta. Predvsem so izpostavljena pravna pravila, ki so se izoblikovala, in razvoj ter prilagajanje sodne prakse posebnostim interneta.

Title:TRANSBOUNDARY BREACHES OF CONSUMER RIGHTS ON INTERNET AND CONSIDERATION OF JURISDICTION
Abstract:This degree dissertation discusses legal issues regarding new technologies and consumer transactions that occur over the internet and how this issues affect the legal regulation of private international law. The core of this dissertation is Brussels Regulation No. 44/2001 on jurisdiction and the recognition and enforcement of judgements in civil and commercial matters, criteria for its use and special rules on jurisdiction in matters relating contracts concluded by consumers. Therefore conditions that has to be fulfilled in order to use protective regime for consumer contracts are introduced and analyzed through case-law of the European Court of Justice, with focus on issues that arise in case of litigation concerning contracts concluded on internet, more precisely the question of international jurisdiction. Especially is emphasized the importance of the European Court of Justice rulings and how the case-law progressed and adapted to modern technologies.
