Abstract:Osebni stečaj je postopek, v katerem fizična oseba zaradi previsokih dolgov skuša te poplačati s svojim osebnim premoženjem, za del dolgov pa lahko tudi zaprosi za njihov odpust. Cilj postopka je, da se dolžnik postavi na noge in poskusi zaživeti brez dolgov. Z odpustom obveznosti se dolžniku olajša njegova situacija, saj lahko podjetnik normalno posluje po zaključenem postopku osebnega stečaja. Po tem se razlikujemo od Nemčije, saj naš sodni sistem nima posledic. Število osebnih stečajev v Sloveniji še vedno narašča. Menim, da je to posledica gospodarske krize pri nas in po vsem svetu, kar vpliva na poslovanje podjetij po vsem svetu. Osebni stečaj lahko pomeni tudi priložnost za nov začetek, vendar samo če se je dolžnik iz tega kaj naučil in če ravna odgovorno in racionalno. Lahko pričakuje strožje obravnavanje finančnih institucij. Zavedati pa se mora, da osebnega stečaja ne more ponoviti prej kot v desetih letih.

Title:SPECIAL FEATURES OF THE BANKRUPTCY OF A SOLE TRADER
Abstract:Personal bankruptcy is a proceeding in which a natural person because of too many debts tries to pay off these debts with his personal assets. For a part of the debts a debtor can request a dismissal. An aim of the proceeding is the debtor’s recovery and debtless life. With the dismissal of debts the debtor’s situation gets easier because he can officiate normally after the proceeding of personal bankruptcy is closed. This is the difference between Slovenia and Germany because our legal system does not direct mayor consequences. The number of personal bankruptcies in our country is still increasing. In my opinion, this is a result of trade depression not only in Slovenia but all over the world and it strongly influences on operation of companies worldwide. Personal bankruptcy can also be an opportunity for new beginning only if the debtor has learned how to act responsibly and economically. In other case financial institution reserve the right to deal harshly with him. The debtors also need to consider that the personal bankruptcy cannot be repeated in next ten years.
