Title:VLOGA NOTARJA V ZEMLJIŠKOKNJIŽNIH POSTOPKIH PRI SKLEPANJU POGODB

Abstract:Pri sestavljanju javnih in zasebnih listin mora notar delovati kot pravni strokovnjak, vsem udeležencem konkretnega pravnega posla pa mora zagotavljati kakovostno, nepristransko in objektivno pravno svetovanje. V diplomskem delu je prikazana zlasti vloga notarja in njegov pomen v zemljiškoknjižnih postopkih pri sklepanju zemljiškoknjižnih pogodb. V skladu z obravnavano tematiko prvi del diplomske naloge temelji na osnovah zemljiškoknjižnega postopka v zvezi s sklepanjem pogodb, predmet katerih so nepremičnine. Podatke o nepremičninah, ki bodo predmet pravnega posla, pridobi notar z vpogledom v zemljiško knjigo. Notar na podlagi pooblastila, ki ga podpiše stranka, v njenem imenu pridobi vse dokumente, ki so potrebni v zvezi s pripravo in sklenitvijo pogodbe, opravi upravne, davčne postopke, sestavi zemljiškoknjižne listine v obliki zasebnih listin oz. notarskega zapisa. V zvezi s sklenitvijo pogodbe notarja običajno stranke pooblastijo tudi za končno izvedbo vpisa pravic posameznikov v zemljiško knjigo. V drugem delu diplomske naloge pa so opisani najpogostejši pravni posli, predmet katerih so nepremičnine. Predstavljena je kupoprodajna pogodba za nepremičnino, menjalna pogodba, pogodba o razdružitvi solastnine, darilna pogodba za nepremičnino, notarski zapis izročilne pogodbe, notarski zapis pogodbe o preužitku in notarski zapis pogodbe o dosmrtnem preživljanju. Pri vseh teh pogodbah je poleg postopka njihove sklenitve pri notarju poudarek na samih listinah, ki bodo sposobne za vpis pravic v zemljiško knjigo.

Title:THE ROLE OF A NOTARY IN THE CONCLUSION OF CONTRACTS IN LAND REGISTRY PROCEEDINGS
Abstract:In preparing documents of public and private matters, a notary must be a legal expert, assuring objective legal consultation of the highest quality. In the paper, the role of notary in concluding land registry contracts regarding land registry procedures is discussed. The first part of the paper discusses the basis of land registry procedure regarding conclusion of contracts that deal with immovable property. Land register enables a notary to get information on immovable property that is the object of legal transaction. Notary’s client authorises the notary to acquire all documents needed for preparation and conclusion of a contract. In addition, a notary performs administrative and tax procedures. He also produces land registry documents in the form of private documents or notarial record. Clients authorize a notary for final implementation of signing in the rights of individuals in a land register. The second part of paper describes the most common legal transactions of immobile property. These include a purchase contract for immobile property, an exchange treaty, a treaty regarding division of mutual property, a deed of gift for immobile property, a notarial record of conveyance deed, a notarial record of care and maintenance of an older farmer on his own farm, and a notarial record of contract regarding lifelong maintenance obligation. The procedure of conclusion of a contract is very important. In addition, the emphasis is on the documents that provide the basis for writing the rights in the land register.
