Abstract:Prepoved diskriminacije kot takšne je ustavno zagotovljena pravica in predstavlja eno izmed temeljnih človekovih pravic. Ljudje smo si različni, razlikovanje ljudi pa samo po sebi ni sporno. Nesprejemljivo postane šele takrat, kadar temelji na določeni osebni okoliščini. Diskriminacija tako pomeni neenako obravnavanje, kjer so ljudje zaradi določene osebne okoliščine obravnavani slabše od drugih. Prepoved diskriminacije v zvezi z zaposlovanjem in delom je pravno regulirana v določbah mnogih dokumentov, sprejetih tako na mednarodni kot nacionalni ravni, kljub temu pa še zmeraj predstavlja pereč problem, ki ne izginja. Diplomsko delo z naslovom »Diskriminacija v zvezi z zaposlovanjem in delom« bralca spozna in seznani z razsežnostjo omenjene problematike ter mu ponudi vpogled v dejansko stanje diskriminacije pri zaposlovanju in delu. Bralca sprva seznani z opredelitvijo diskriminacije kot takšne, s pravnimi viri, v katerih je prepoved diskriminacije pri zaposlovanju in delu urejena, nadalje z najintenzivnejšimi pojavnimi oblikami diskriminacije ter s sodno prakso sodišča Evropske unije, kjer je Sodišče kot splošno načelo prava Evropske unije potrdilo načelo prepovedi diskriminacije pri zaposlovanju. Diskriminacija v zvezi z zaposlovanjem in delom kljub ustrezni regulaciji ostaja, ranljive skupine ljudi pa so zaradi predsodkov, stereotipov ter ekonomskega vidika še zmeraj prepuščene dobri volji ter interesom delodajalcev.

Title:DISCRIMINATION AT EMPLOYMENT AND WORK
Abstract:Prohibition of discrimination as such is constitutionally guaranteed right and is one of the fundamental human rights. People are different, distinguishing people by itself is not controversial. It becomes unacceptable only when it is based on certain personal circumstances. Discrimination means unequal treatment, where people due to some personal circumstances are treated worse than others. Prohibition of discrimination in respect of employment and work is legally regulated by the provisions of a number of documents adopted at both international and national level, but however, still remains a huge problem. The thesis entitled "Discrimination in respect of employment and work", acquaints the reader with the dimension of this problem, and offers insight into the actual situation of discrimination at employment and work. The reader is first acquainted with the definition of discrimination as such and the sources of law in which the prohibition of discrimination at employment and work is regulated. Further the reader is informed about more intense manifestations of discrimination and the case law of the Court of the European Union. Discrimination in respect of employment and work remains despite adequate regulation. The vulnerable groups of people are due to prejudices, stereotypes and economic point of view, still left to the good will and interests of employers.
