Abstract:Predstavljena je problematika sodnih zaostankov v Republiki Sloveniji. Analizirani so podatki iz uradne sodne statistike za obdobje od 1990 do 2011. Obravnavan je referenčni modus, ki je opisan z linearno padajočo produktivnostjo ob konstantem pripadu zadev. S pomočjo metodologije sistemske dinamike je bil razvit model, s pomočjo katerega je bilo ugotovljeno, da se bo ob nadaljeanju trenutnih trendov število sodnih zaostanov le povečevalo, saj temu botruje padajoča produktivnost. Različni scenariji dajejo odgovor, da tudi mediacije na daljši rok ne bodo prispevale k zmanjšanju sodnih zaostankov. Podanih je tudi nekaj teoretičnih osnov o pravni državi, pravicah, pravni praksi in ukrepih za zmanjšanje sodnih zaostankov.

Title:MODELING AND SIMULATION OF THE IMPACT OF ORGANIZATIONAL STRUCTURE AND PRODUCTIVITY ON COURT DELAYS
Abstract:The thesis describes the problem of court delay and proposed solutions. The data from Slovenian courts for the period 1990–2011 is analyzed. We found that, while the number of incoming cases each year could be considered as constant, the productivity of the judicial system decreases by the negative linear trend. The problem of court delay was modeled using the System Dynamics approach. The developed model enabled us to test different plausible scenarios showing that mediations will not help to decrease court delays. The thesis also features some theoretical aspects about legal state, rights, jurisprudence, court decisions and measures to decrease court delays.
