Title:(NE)UČINKOVITOST PODALJŠANJA PRAVIC GLASBENIH IZVAJALCEV

Abstract:Trajanje pravic glasbenih izvajalcev je na ravni EU harmonizirano, kar pomeni, da je v tem aspektu avtonomija držav članic EU omejena. Diplomsko delo obravnava Direktivo 2011/77/EU, ki podaljšuje trajanje varstva pravic izvajalcev na fonogramih s 50 na 70 let, pri čemer analizira vprašanje učinkovitosti takšnega podaljšanja pravic. Diplomsko delo izpostavlja, da je v zvezi s tem treba po eni strani najti ravnovesje med podeljevanjem pravic posameznikom in javnim interesom, po drugi strani pa je treba izpostaviti razmejitev med pravnim položajem in praktičnim uresničevanjem pravic glasbenih izvajalcev ter proizvajalcev fonogramov. Problematika, ki izhaja iz tega, je v praksi obsežna, vendar ji pravo posveča premalo pozornosti ali pa sprejema ukrepe, ki so glede na naravo glasbene industrije in vpliv tehnološkega napredka nanjo prepočasni ali premalo učinkoviti. Kljub alternativnim možnostim glasbenih izvajalcev za ohranjanje svojih pravic in novim klavzulam za izboljšanje njihovega pravnega položaja ima pravo tako na mednarodni ravni, ravni EU ter nacionalni ravni vrsto pravnih možnosti, s katerimi bi se lahko stanje v okviru obravnavane tematike izboljšalo.

Title:(IN)EFFECTIVENESS OF PROLONGING THE MUSIC PERFORMERS RIGHTS
Abstract:On the EU level the duration of music performers' rights is harmonized, which means, that in this regard the legislative autonomy of the member states is limited. This graduate paper focuses on the Directive 2011/77/EU, which extends the duration of performers' rights on phonograms from 50 to 70 years, and analyzes the effectiveness of such prolongation. The paper highlights the necessity of upholding the balance between the rights of individuals versus the public interest, and on the other hand discusses the differences between the legal basis and the implementation of performers' and phonogram producers' rights in practice. Various issues emerge from this situation, but encounter insufficient interest on part of the legislators or are met with actions, which, considering the nature of the music industry and the influence of technological advances, often prove to be too little, too late. Despite alternative options of music performers to retain their rights, and new clauses that improve their status, international, EU and national legislative measures offer a variety of opportunities to further improve the current state of affairs.
