Title:PRAVICA OTROKA DO ZASEBNOSTI

Abstract:Zasebnost je ena izmed najpomembnejših človekovih pravic. Pojem zasebnosti pa postaja še pomembnejši, predvsem zaradi vedno večje individualizacije in s tem manjšega zaupanja med ljudmi, kakor tudi zaradi dostopnejših tehnologij, ki omogočajo nadzor in povezovanje pridobljenih osebnih podatkov. V diplomski nalogi je opredeljen pomen pravice do zasebnosti in njene značilnosti v današnji družbi, ki bi ji lahko rekli tudi kar družba nadzora. Pravica do zasebnosti nedvomno spada med najkompleksnejše človekove pravice in ta kompleksnost se začne že pri definiranju. Na prvih straneh sem skušala najti enotno in nedvoumno definicijo pravice do zasebnosti, v nadaljevanju pa sem opisala pravico do zasebnosti skozi njen zgodovinski razvoj. Izpostavila sem pravico do varstva zasebnosti, torej pravico, ki nam daje možnosti biti sam in obdržati kakšno skrivnost samo zase. Opisala sem tudi vse pomembnejše pravne dokumente, ki varujejo pravico do zasebnosti, tako na ravni Evropske unije in mednarodne skupnosti ter na nacionalni ravni. Razvoj pravice do zasebnosti in definicija pojma zasebnosti sta namreč zelo pomembna za nadaljnje razumevanje pravice do zasebnosti v slovenski zakonodaji ter uporabi in razlaganju pomena te pravice skozi domačo in tujo sodno prakso. V nadaljevanju sem se osredotočila na otrokovo pravico do zasebnosti in opisala pomembno vlogo otroka v razmerju do svojih staršev. Prav tako sem poskušala vsaj načelno opredeliti kako se uresničuje otrokova pravica do zasebnosti v razmerju do staršev, ki imajo roditeljsko pravico, da varujejo otrokove koristi. Dejstvo je, da se vsak starš odloča po subjektivnih merilih o tem, kdaj bi bilo primerno otroku zaupati in mu s tem dati postopoma vedno več zasebnosti. Izhodišče diplomske naloge torej predstavljajo razmerja med starši in otroci, znotraj katerih je predstavljena tudi roditeljska pravica, izvrševanje in nadzorstvo nad izvrševanjem le-te. Skozi diplomsko nalogo bom predstavila praktične primere mej otrokove zasebnosti in tako prikazala kompleksnost ter različnost tega pojma od primera do primera. Osredotočila sem se tudi na vlogo otroka in njegovo pravico do zasebnosti, ki jo udejanja v šoli. Dotaknila pa sem se tudi otrokove pravice do zasebnosti na internetu, saj je internet probleme zasebnosti prenesel v virtualni prostor, v katerem informacijsko komunikacijska tehnologija omogoča številne nove tehnične načine zlorab zasebnosti. Celotno nalogo sem sistematično razdelila na različna poglavja, kar diplomski nalogi daje večjo preglednost in s tem lažje razumevanje. V diplomskem delu sem se osredotočila predvsem na zakonodajo s področja varstva zasebnosti, prav tako pa tudi na konvencije, ki ščitijo pravice in koristi otroka.

Title:CHILD'S RIGHT TO PRIVACY
Abstract:One of the most important human rights is privacy. Lately, the concept of privacy is getting more important due to the increasing individualization, the consequence of which is lack of trust and accessible technologies that enable control and integration of obtained personal data. Diploma defines the meaning of the child’s right of privacy and its characteristics in today’s society which could easily be called a society of control. The right of privacy is definitely one of the most complex human right and its complexity starts with its definition. First I tried to find a unified and unambiguous definition of what the right of privacy actually is. Next, I describe the development of this right through history. The right of protection of privacy is highlighted, meaning the right of being by ourselves and keeping a secret or telling it only to our closest friends or relatives. I describe all of the important law documents that protect the right of privacy on the level of the European unit, the international community and on the national level. It is important to understand the development of the right of privacy and its definition. Only then we can understand how it is being used in Slovenian law and the meaning of this right in domestic and foreign law practice. Diploma also focuses on the child’s right of privacy and describes the important role of a child in relationship with his parents. I tried to define how this works in practice, since parents do have the parental right to work in child’s best interest. The fact is that every parent decides personally when is the child mature enough to be trusted and with thus give him more privacy. The starting point of the diploma is the relationship between parents and children, which includes the parental right, enforcement and control over exercising it. Through the diploma I present actual examples of limits of child’s privacy. With this I demonstrate the complexity of this concept and how different examples are from one another. I also focus on the role of the child and his right to privacy at school. Children also have the right of privacy on the internet. On line there are also problems with privacy. Today’s technology enables a lot of different ways to abuse privacy. Diploma is divided by chapters which make it easier to read and it is more in order. The content mostly focuses on the legislation of protecting one’s privacy and different conventions which protect the rights and benefits of children.
