Abstract:Razveza zakonske zveze je ena izmed oblik prenehanja zakonske zveze. Naš pravni sistem pozna dve vrsti razveze; to sta razveza na podlagi sporazuma zakoncev in razveza zakonske zveze na podlagi tožbe. Medtem, ko avstrijsko pravo pozna tri razveze zakonske zveze, in sicer razvezo zaradi krivde, razvezo zaradi razpustitve gospodinjske skupnosti, ki traja vsaj tri leta ter sporazumno razvezo. Spor o razvezi je zakonski spor, tako da bodo podlaga za pisanje diplomskega dela določbe Zakona o pravdnem postopku, ki uvršča postopek v zakonskih sporih med posebne postopke. V avstrijskem pravu sporazumna razveza poteka v nepravdnem postopku, tj. po določbah zakona o nepravdnem postopku (Außerstreitgesetz), v ostalih primerih se vodi pravdni postopek v skladu z Zakonom o pravdnem postopku (Zivilprozessordnung). Cilj diplomskega dela je prikaz podobnosti in razlik pravne ureditve postopka razveze zakonske zveze v Republiki Sloveniji in Republiki Avstriji. Opažam, da je v obeh pravnih redih postopek sporazumne razveze zakonske zveze najpreprostejši način prenehanja zakonske zveze, ter da se v obeh pravnih sistemih v ozadju določb skriva želja po spravi med zakoncema, če je to možno pričakovati. Sodna praksa sledi načelu, da sta tako sklenitev kot razveza zakonske zveze svobodna odločitev vsakega posameznika ter da za ohranitev zakonske zveze ni dovolj le želja in volja enega izmed zakoncev. Poleg postopka razveze v obeh pravnih sistemih bom konkretneje predstavila Uredbo Sveta (EU) 1259/2010 o izvajanju okrepljenega sodelovanja na področju prava, ki se uporablja za razvezo zakonske zveze, ter Uredbo Sveta (ES) št. 2201/2003 o pristojnosti in priznavanju ter izvrševanju sodnih odločb v zakonskih sporih in sporih v zvezi s starševsko odgovornostjo. Moje teze, iz katerih izhajam, so: • Raznolikost pravne ureditve razveze zakonske zveze v Sloveniji in Avstriji. • Priznavanje odločb tujih sodišč. • Stroškovna plat razveze zakonske zveze. Pri pisanju diplomskega dela bom izhajala iz znanja, pridobljenega skozi študij, ter uporabe pravnih aktov, znanstvene monografije, člankov, spletnih virov ter sodne prakse. Omejitev pri pisanju diplomskega dela bo predstavljala geografska razdalja, saj se bom osredotočila na podatke o ureditvi instituta razveze v dveh pravnih sistemih dveh različnih držav.

Title:DIVORCE PROCEEDINGS IN SLOVENIAN LEGISLATION, A COMPARISON WITH AUSTRIA
Abstract:Divorce is one of the forms of terminating the matrimonial contract. Our legal system has two kinds of divorce; one is consensual divorce, and the second is divorce on the basis of lawsuit. Whereas, Austrian legal system has three kinds of divorce; divorce due to guilt, divorce due to abandonment of household community, which has to last at least three years, and consensual divorce. Dispute concerning divorce is a matrimonial matter, so the base of the thesis comes from the Code of civil procedure (Zakon o pravdnem postopku), which classifies the proceeding of matrimonial matters in special proceedings. In Austrian legal system, the consensual divorce is dealt with as the proceeding without a lawsuit, that is according to the Code of proceedings without a lawsuit (Zakon o nepravdnem postopku), in other cases, civil procedure is used in accordance to the Code of civil procedure (Zakon o pravdnem postopku). The goal of the thesis is to show the similarities and differences of legal regulations concerning divorce proceedings in Slovenia and Austria. I notice that in both legal orders, consensual divorce is the easiest way of terminating the matrimonial contract. Also, it can be noticed that in the background of both legal systems, there is a wish of reconciliation between the spouses, as long as that could be expected, of course. Judical precedence follows the principle that marriage and divorce are a free choice of every individual, and that preservation of marriage does not depend only on the wish and the will of one spouse. Besides divorce in both legal systems, I also deal with Council Regulation (EU) No. 1259/2010 of 20 December 2010 implementing enhanced cooperation in the area of the law applicable to divorce and legal separation, and The Council (EC) Regulation No. 2201/2003 of 27 November 2003 concerning jurisdiction and the recognition and enforcement of judgments in matrimonial matters and the matters of parental responsibility, repealing Regulation (EC) no. 1347/2000 (i.e. Brussels Regulation IIa). My arguments are: • The diversity of legal regulation of divorce in Slovenia and Austria. • Recognition of judgments of foreign courts. • Costs of a divorce. When writing the thesis I derive from the knowledge gained through the study, the use of legal instruments, scientific monographs, articles, online resources, and case law. Geographical distance will represent restrictions on writing the thesis, as I will focus on the details of the organization of the institution of divorce in two different legal systems of the two countries.
