Title:PATENTNO VARSTVO POSTOPKOV ZDRAVLJENJA

Abstract:Postopki zdravljenja so predmet posebne obravnave v patentnem pravu. Na podlagi člena 53(c) Evropske patentne konvencije so kirurški postopki, terapevtsko zdravljenje ter diagnostične metode izključeni iz patentnega varstva, torej jih ni mogoče patentirati. Omenjena določba se ne nanaša na izdelke, zlasti snovi ali sestavke, ki se uporabljajo pri kateri izmed metod zdravljenja. Tekom obravnavanja diplomskega dela ugotavljamo, da je izraz metode zdravljenja ozko interpretiran, zaradi česar nekatere zahteve ne spadajo v izključitev v smislu člena 53(c) Evropske patentne konvencije in jih je mogoče patentirati. Patentno varstvo je mogoče zagotoviti tudi za naprave, v primeru, da med človeškim telesom in metodo zdravljenja ni tesne povezave. V drugem delu se posvetimo tudi obravnavi kozmetičnih metod, kjer se pokažeta kozmetični učinek, ki ga je mogoče patentirati ter terapevtski učinek (nepatentibilen). Na koncu so opredeljene tudi metode kontracepcije, ki jih je sicer mogoče patentirati, ker nosečnost ni opredeljena kot bolezen, vendar so le redko predmet patentnega prava, zaradi posrednega terapevtskega učinka.

Title:PATENT PROTECTION OF MEDICAL METHODS
Abstract:Medical methods are subject of special treatment by patent law. On the basis of Article 53(c) of the European Patent Convention, surgical procedures, diagnostic and therapeutic treatment methods are excluded from patent protection, so they cannot be patented. This provision does not apply to products, in particular substances or compositions, for use in any of the methods. During this thesis, we define that the term medical treatment is narrowly interpreted, and because of that some of the requirements do not fall within the exclusion in Article 53(c) of the European patent convention so they can be patented. If there is no functional link or nexus between human body and device it is possible to provide patent protection for implantable device. In second part of thesis we discus about cosmetic methods which have two points of view, first the cosmetic effect, which can be patented and second the therapeutic effect (non-patentable). At the end are also defined methods of contraception that are patentable because pregnancy is not defined as a disease, but they are rarely the subject of patent protection because there is an indirect therapeutic effect.
