Title:Analiza sprememb policijske zakonodaje in odnos policistov do teh sprememb : diplomsko delo univerzitetnega študija

Abstract:Diplomska naloga prikazuje spremembe policijske zakonodaje in odnos, ki ga imajo policisti do teh sprememb. Teoretični del se začne z analizo sprememb policijske zakonodaje vse od Zakona o notranjih zadevah iz leta 1980, do Zakona o policiji iz leta 1998 in njegove novele, na koncu pa sta zajeta tudi oba zakona iz letošnjega leta – Zakon o nalogah in pooblastilih policije ter Zakon o organiziranosti in delu v policiji. Pri tem smo bili osredotočeni na naloge in pooblastila policistov in policistk. Sledi kratek pregled policijske dejavnosti in nekaterih zakonskih določb v tujih državah. Za primerjavo smo si izbrali Avstrijo, Nemčijo, Hrvaško, Češko in Slovaško. Gre za države, po katerih se Slovenija na področju policijske dejavnosti zgleduje, je malce bolj napredna oziroma je na isti razvojni stopnji. V zadnjem poglavju teoretičnega dela smo se osredotočili še na etično perspektivo policijske zakonodaje. Že omenjene zakone, ki smo jih analizirali na začetku, smo primerjali s Kodeksom policijske etike in iskali vzporednice med kodeksom in zakoni. Sledi empirični del, ki obravnava odnos, ki ga imajo policisti do sprememb zakonodaje, ki vpliva na njihovo delo. Rezultati raziskave so pokazali, da policisti menijo, da so spremembe policijske zakonodaje prepogoste, poleg tega pa se pri spreminjanju premalo upoštevajo njihovo mnenje in predlogi. Glede večjega števila pooblastil, ki ga je prinesla nova zakonodaja, je mnenje policistov razdeljeno. Zadnjih sprememb namreč niso ocenili niti kot dobrih niti kot slabih.

Abstract:This diploma thesis displays the changes of police legislation and police officers' attitude toward these changes. The theoretical part starts with the analysis of changes in police legislation, from The Internal Affairs Act of 1980, to Police Act of 1998 and its' amendments and at the end are included both acts of this year – Act on the tasks and powers of police and Act of the organization and work of the police. We were focused mainly on tasks and powers of policemen and policewomen. What follows is a brief overview of policing and some legislation provisions in foreign countries. For comparison we chose Austria, Germany, Croatia, the Czech Republic and the Slovak Republic. These are the countries that serve as an example for Slovenia, of which our country is more developed or at the same developmental stage. In the last chapter of the theoretical part we have also focused on the ethical perspective of police law. We compared already metioned laws, which were analyzed at the beginning, with the Code of Police Ethics and we searched for paralels between the Code and the laws. The empirical part deals with the police officers' attitude toward changes in legislation that affects their work. The survey results showed that police officers believe that changes in police legislation are too frequent, moreover there is lack of consideration given to their opinions and suggestions about changing the police legislation. Police officers have shown divided opinion about a large number of powers of police, brought by the new legislation. Recent changes were not considered neither as good neither as bad.
