Title:ELIPSA IN DANA/NOVA INFORMACIJA V TRANSKRIBIRANIH ZAPISIH GLAVNIH SODNIH OBRAVNAV

Abstract:Z namestitvijo snemalnih naprav v razpravne dvorane se je v slovensko sodno prakso vpeljala pomembna novost, in sicer zvočno snemanje glavnih obravnav in narokov v sodnih postopkih. Pridobljeni zvočni posnetki so kasneje prepisani – transkribirani in pomenijo pomemben pisni vir tako za pravnike kot za jezikoslovce. V osnovi so ta besedila še vedno govorjena. Besedilnoskladenjske značilnosti govorjenega diskurza se razlikujejo od pisnega diskurza. Te so predmet našega raziskovanja. Za kompleksnejše razumevanje jezika v pravu smo se morali seznaniti s pravnim jezikom. Na osnovi transkribiranih zapisov glavnih sodnih obravnav Okrožnega sodišča v Mariboru smo napravili analizo elipse in dane/nove informacije. Besedno elipso smo ločili po stavčnočlenskih merilih, in sicer: elipsa v povedku, elipsa v imenskem delu ter stavčna elipsa. Elipso smo obravnavali kot jezikovnosistemsko prvino, ki prispeva k ekonomičnosti izražanja in/ali stilno prvino, ki uvaja v besedilo posebne stilne učinke. Dane/nove informacije smo preučevali v informacijski strukturi izreka. Pri analizi smo bili pozorni predvsem na danost. Transkribirane zapise smo obravnavali z namenom, da se ugotovi, kako elipsa, kot skladenjska modifikacija besedilnega povezovanja vpliva na razumevanje govorjenega diskurza. Posebej nas je zanimala korelacija elipse in dane/nove informacije. Analiza elipse, danega in novega pa nas je privedla na področje jezikovne forenzike in želje, da prikažemo jezikoslovje tudi kot uporabno vedo v praksi in kot pomembno interdisciplinarno vedo.

Title:ELIPSE AND GIVEN/NEW INFORMATION IN TRANSCRIBED RECORDS OF HIGH COURT HEARINGS
Abstract:The installation of recording equipment in courtrooms introduced an important innovation in Slovene court proceedings, namely the sound recording of main hearings and hearings in legal proceedings. The sound recordings are transcribed as texts and represent a major written source for lawyers as well as for linguists. Transcripts remain of the same value as spoken texts. However, the syntactic characteristics of spoken discourse differ from those of written discourse, and are the subject of the present study. First of all, to understand the complexity of legal language, in-depth familiarization with its distinctive features was necessary. The analysis of ellipsis and given/new information was based on the transcripts of the Maribor District Court main hearings. Textual ellipsis was classified according to the sentence structure criteria: verbal ellipsis, nominal ellipsis, and clausal ellipsis. Ellipsis was considered as a linguistic-systemic phenomenon contributing to the economy of expression, and/or as a stylistic feature exploited in texts for special stylistic effects. Given/new information was examined as part of the information structure of discourse. The analysis was focused primarily on the given part. Transcripts were addressed with the intention to explain how ellipsis, as a syntactic modification of textual valence, affects the understanding of spoken discourse. Here, the correlation between ellipsis and given/new information was of special interest. The analysis of ellipsis, and of given and new information led to the sphere of linguistic forensics with the wish to present linguistics as a significant interdisciplinary and applied science.
