Title:OBVEZNO PRENEHANJE POGODBE O ZAPOSLITVI

Abstract:V diplomski nalogi je obravnavano vprašanje obveznega prenehanja pogodbe o zaposlitvi, ki se nanaša na tiste starejše delavce, ki izpolnijo pogoje za pridobitev pravice do starostne pokojnine. Na tem mestu pa se odpre pomembno vprašanje, ali je tak institut sprejemljiv v posameznih nacionalnih pravih ali morebiti ne predstavlja diskriminacije na podlagi starosti in na podlagi spola. Republika Slovenija takega instituta, razen za določene kategorije delavcev, ni poznala in je delavec lahko nadaljeval z opravljanjem dela tudi po tem, ko je dopolnil pogoje za upokojitev. Letos pa je Državni zbor sprejel poseben zakon, ki spreminja in dopolnjuje določbe različnih zakonov, njegov namen pa je rast in vzpostavitev dolgoročnega razvoja Republike Slovenije. V ta zakon je uvedel tudi prenehanje pogodbe o zaposlitvi vsem javnim uslužbencem, ki izpolnijo pogoje za pridobitev pravice do starostne pokojnine. Države v svojih nacionalnih predpisih lahko zakonsko uredijo obvezno prenehanje pogodbe o zaposlitvi za nekatere posebne kategorije delavcev, vendar mora biti taka ureditev jasna, določna in ne sme biti neutemeljeno diskriminatorna. Tudi Sodišče EU je zavzelo stališče, da je tak ukrep upravičen, če gre za sorazmerno sredstvo za dosego legitimnega cilja socialne politike, povezane s politiko zaposlovanja in trga dela. Načini uresničevanja ciljev zaposlitvene politike in delovnega trga pa morajo biti v splošnem javnem interesu, razumni, nujni in sorazmerni. Tak ukrep bi sicer pripomogel k večji zaposljivosti mladih, saj bi se sprostilo kar nekaj delovnih mest. Kljub temu pa menim, da je tak ukrep diskriminatoren do starejših delavcev, ki želijo delati dlje od predvidene upokojitvene starosti in si v tej finančni krizi izboljšati svoje gmotno stanje. Prav tako pa tak ukrep ni v skladu z aktualnimi cilji sedanje socialne politike in napovedane reforme pokojninskega sistema, katere namen je povišanje upokojitvene starosti.

Title:MANDATORY TERMINATON OF EMPLOYMENT CONTRACT
Abstract:The graduation thesis addresses the issue of compulsory termination of the employment contract regarding those older employees who meet the requirements for the entitlement to the statutory old-age pension. At this point an important question emerges whether such an institution is acceptable for individual national laws or whether it might suggest discrimination on the basis of age and gender. In the Republic of Slovenia employees have always been able to continue with their work after fulfilling the conditions for retirement. However, this year The National Assembly has adopted a special law, changing and complementing any regulatory or legislative provision, providing sustainable growth and long-term development of the Republic of Slovenia. The new law provides the immediate termination of the employment contract of all public employees as soon as all conditions for the entitlement to the statutory old-age pension are fulfilled. Countries in their national regulations are able to regulate the compulsory termination of the employment contract for some specific categories of employees; however such regulation should be clear, precise and may not be unreasonably discriminatory. The EU Court of Justice has also taken the position that such measures are justified concerning proportionate means for achieving a legitimate social policy objective related to the employment policy and the labour market. The means of achieving the objectives of the employment policy and the labour market should be of general public interest, reasonable, necessary and proportionate. Such a measure would help to increase the employability of young people, as it would free the availability of several posts. However, I believe that such a measure is discriminatory against older employees who want to work longer than planned retirement age and are therefore able to improve their income in this financial and economic crisis. Such a measure is also not in accordance with current social policy objectives and forthcoming reforms in the pension systems, which aim to increase the retirement age.
